Contractor issue

i’m Located in Michigan.
We hired a contractor to remodel a room. He was given 50% up front with the assurance that the project would be completed by 7/9/2018, it is not completed yet.
There are still issuers with the plumbing,electrical, drywall and trim work. I’d say the project is 50-75% complete so far. My problem is it wasn’t completed when he said it would be and now he hasn’t shown up for 13 days.
What are my legal options for firing him? I don’t recall signing any contract at the time of payment.

He wouldn’t answer any emails and when I finally was able to contact him on the phone he stated that they had gotten behind on projects and were playing catch up. Said he’d be here on Monday(8/6/2018) and has not shown up yet.

And that isn’t sarcastic: you stated you don’t recall signing any contract at time of payment. I don’t know if that meant you didnt sign any contract or just not at the time of payment.



If you don’t have the completion date in writing, it will likely be seen as a suggested or speculated time of completion. In other words: not likely to be enforceable as part of the contract.



I’m curious (and this could help you possibly)

Does this guy have all the proper licensing for the work he has performed? If he subbed any of the work to others, were they properly licensed?

Were there permit for the work pulled? Has the work been inspected by the local building/electrical/plumbing inspector?

He has a fairly well advertised business here in town but I do not know if he has lisences to do the work being performed. I do know that there were no permits pulled to do any of the work. There hasn’t been any formal inspections done either.

You can contact your city (township) clerk to see if permits were obtained.

It is not uncommon for a contractor to stop giving any priority to a project that they know they will get no more money on until the job is completed. They run out of money to pay their people or for themselves, so they start a new job where they can get some upfront money and give that job priority instead.

You could let him know that if he doesn't have the job done by XX date, that you will hire someone else to finish it and bill him for any extra cost incurred. That might get you some priority.

There is the possibility that there were emergency storm-damage repairs that were made a priority. We have had some nasty weather in areas of the state in the past several weeks.
