Father Evicted

What is the name of your state? IN

For visitation, what is my best bet if the father of the children has an eviction order in place according to the county website. Do I have to still legally let the children go with him, ages 14, and 11? Where will they be, what are they doing, etc. The father won't say anything or admit to anything. Do I just have to let them go and taker him to court? I know he will call the cops at 6PM on Friday if I am not there to bring the kids, which I am not worried about either.

Does he have family in the area? Does he make decent enough money for a hotel room (maybe not if he has been evicted). You cannot assume that he will be living in his car with them. The kids are certainly old enough to tell you if something like that happens.

If your oldest doesn't already have a phone it might be a good time to get one.

You can't ignore the court order. Just because there is an eviction "order" in place doesn't mean he doesn't still have a place to stay. He could take them to a hotel in the area if not his home. Why would you take him to court? Your children are of an age where they can somewhat self protect.

My only concern is what he is doing with his money to get evicted, he hangs out with druggies, and your right the kids are old enough, they are around drugs, and 15 year old stealing cars. I just don't want the kids to follow in that when they are with their father as he things its all funny, he already has min rights, as I have sole physically and legal custody, because he was masturbating to them. Hence why I received the custody I did.

How much times does he actually spend with them? Is it every other weekend or more or less than that?

Its suppose to be that, however its 1 weekend a month and maybe 1 day during the week a month.
That is pretty minimal. The children have far more time to be influenced by you and the people around you. Just make sure that your oldest has a working phone.

She does not, because she cannot be responsible, etc posting stuff to social media, etc.
What is more important? To keep her off social media or provide a means of communication with you if things go hinky with dad being evicted? It doesn't have to be a smart phone.

Correct. I agree, however she wont call anyways, she is very loyal to her father, he could be evicted and he say he isnt and they are being thrown out and she will believe him, the 14 year old that is, the 11 year can see through all the BS.

Very true - in fact, there are phones that can be restricted to only calling certain numbers, as well as watches that are phones that include GPS tracking and "SOS" functions.
