Annulment for Fraud

I'm looking on information about an annulment for fraud. My partner lied about something serious and no reasonable person would have married them if they knew.

I have some questions:

* I can't find the statute on the New York state pages. I only found it on a law firm's web page. Does anyone know the official link?

* Does anyone know links to an open, publically-viewable case database that shows real NY cases where annulments were granted by fraud that are more recent than Rich vs. Rich in 1972?

Edit: I'm overseas now but I can get it annulled locally if i can demonstrate that it would be annullable under local law where there ceremony happened (NY).

I'm sorry. The only time I remember posting here I'd recently been sexually assaulted and I asked for some advice. I remember getting one answer that basically called me a drunken slut (even though I hadn't been drinking and wasn't wearing revealing clothes) and wasn't constructive. I didn't want to leave it up to upset other women who might search for answers here.

What was it that your husband lied about? How long have you been married? Why don't you just divorce him?

I'd rather not say ... 3 years (learned about the fraud 2 months ago and we haven't cohabited since I learned) ... I prefer an annulment due the (private) specifics of the fraud.

Sunny - let's think about this logically.

You're asking us for links to a database that would have all the personal details about annulments that have been granted because of fraud but your own situation is such that you don't want to give us details.

Do you realize that either:

1.) Your own annulment would thus show up on the same database with all your pertinent details open to the public as well OR

2.) Out of respect for the privacy of the individuals those details would have been suppressed on any publicly viewable data base?

Not an easy quest wo good lawyer .

In addition NY requires you file within 3 years of discovery of the fraud and that you relied upon the fraud at the time of the marriage .

Some major blot in his past may or may not be relevant to marriage ....you need to address that with NY counsel . ( some here, not me, might have useful insight as to if nature of blot you chose to relate is a likely ground for annulment in NY ...and if you mean some sexual preference or ability...you want some up to date help not some old moldy stuff ...

He married me intending to transport me overseas, drug me and record himself raping me while drugged, and sell the recordings. All the legal stuff with his crime is being handled here.

I prefer the dignity of an annulment. I just need to demonstrate I could qualify for an annullent in NY. I don't have to get the annulment in the US.

Is there any chance you can see your way to answering the questions in my first post now? I would really appreciate it.
