Charged with filing false police report for giving my accurate recollection of accident

To summarize it. A car was turning into a parking lot, I was running really fast home. Didn't see the car and we collied into each other. I was in the middle of the cross walk when. We collied. Went over the drivers side hood area and side of the drivers side. The video looks like I ran Into the car so the police man arrested me for making a false police report because in his statement he says the video contradicts what I said.... But I have the video it's exactly almost how I imagined it. How can he charge me with lying if I gave him my honest statement? I have no history and had no reason to lie. I knew there were cameras all over.... And I'm still confused on what he thinks I even lied about and my public defender just wants me to plead guilty but I didn't lie....

If you want to take it to trial and see if a jury thinks you lied that is your right. Maybe a jury after seeing the video and reading your report of it will agree with you that they match. I have no way to guess how it would come out because I have not seen the video and the report you made.

If you were in the crosswalk before the car entered the crosswalk the car is in the wrong even if you ran into the car. What does the video show there?

If the car was turning into a parking lot and you were in a crosswalk, how could you two collide? They don't put crosswalks in driveways. Crosswalks cross streets.

Untrue. Both under the Oregon revised statutes or in common practice. All it has to be is "distinctly indicated for pedestrian crossing". They can be on a "roadway at an intersection or elsewhere"

That video looks to me like the pedestrian jumped on the car and not to protect himself but to make it look like the car hit him.

Yea, I never saw the car when running. It's already been concluded that I didn't jump into the car. I'm just fighting if I lied or not.

I'm not sure that your movement on to the car wasn't just an instinct to avoid more serious injury. So, no, I don't think you filed a "false" police report by alleging that the driver was at fault. The cop was an idiot to arrest you for that and the prosecutor would be a bigger idiot to take it any further. I think a lawyer can easily get you acquitted on that charge. In any accident there are always two sides to the story each side blaming the other. That's human nature. It would truly be a sad state of affairs if cops had to charge one of the drivers in every accident for filing a false police report just because he didn't believe one of them.

Fault is another story. At 1:21 in the video the car enters the frame. You're not in the frame. At 1:22 the cars wheels turn to the right and the car begins to make the turn. You're still not in the frame until about a half second later. I think you should have seen the car entering the turn before you ran into the street. That you didn't see what the video clearly shows means that you weren't paying attention to what was going on ahead. And that is what puts you at fault for your own injuries.

Consult a personal injury lawyer and review your options.

Meantime, make sure you have an attorney for the false police report charge.

Thank you so much for understanding. I myself don't know how I didn't see the car turning. My only guess is it's because it was coming at an angle, And I had sunglasses and was running fast to go home. I'm a very safe person and always try my best to avoid cars.

What's your opinion on my lawyer wanting me to plead guilty instead of going to a jury? Is it because she's a Public Defender and just wants to get through her cases fast or could it be something else?

I told my caretaker that I would rather risk spending 1 year in jail for something I didn't do then plead guilty for something I didn't do.

This isn't the first time my words got my in trouble. I got a DUI when sleeping in my car at home because a cop thought my speech sounded like I was under the influence and how I explained things wasn't what a sober person would do. I waited 3 months for them to drop that once the blood test came back. So it's not, not common for police officers to not believe me for some reason. I think it's my intellectual disabilities that make them think that idk. But any help is very much appreciated. I've been having nightmares for the past 2 months since I was arrested and am too afraid to even go outside anymore.
