You should make it clear to your passengers that you are recording the ride, both with signs and orally. Don't try to live stream your rides with passengers.

Ah. Good question. :)

If the passengers are not being recorded, a dash camera should not be an issue.

Many Uber and Lyft drivers are installing cameras that record the passengers, (arguably) for their own protection. Unfortunately, some drivers have been live streaming their rides for monetary gain, leading to invasion of privacy claims filed against drivers by passengers who were unaware they were being filmed. Drivers have been dismissed from their employment as a result.

In New York, invasion of privacy claims must be filed under New York's civil rights laws, and are (generally) confined to those cases where a person's personality rights have been infringed for the commercial gain of another.
