The court is in New York.
I am looking for help and advice as I have been accused of small numbers of books that had been centerfield that I did not know about it. I received the notice last Wednesday and the preliminary hearing is on January 31, 2019.

Where are you located?

I am not sure what the court action is (infringement?) but, because you do not have much time before you need to appear in court, I recommend you find an attorney in your area for advice and direction.

I am in Canada and the court is in NY and I received an email last Wednesday just one week before and this is not enough time to do anything. I sold a very small number of books under the eBay umbrella since last September.

Were these books you sold ones you purchased legally and are they legal (rather than counterfeit) copies?

Most of the books are legal and I thought all book are legal and maybe I sold about 20 books in total and sold in US.

The rights-holder can be awarded treble damages/losses or your profits, and attorney fees can be awarded, should the lawsuit be successful against you.

Although time is short, I recommend you have all facts personally reviewed by an IP attorney in your area. I would not head into a New York court without this review (if you should head to a US court at all).

Are you located close to the US/Canadian border?

How much did you pay for the books and how much did you sell them for?

And what kind of records did you keep about where you bought them from?

I am curious about from whom the email came and what exactly it said. There should be more than a one week notice.

If an attorney is used for nothing else, an attorney should be contacted prior to the court date to look at the emailed notice and determine it's legitimacy.
