Can you sue a bank for a breach of confidentiality?

My sister sold deposited a fake cheak into my checking account and then they let her cash my personal check an gave her the money while I was out of town more than a week later the bank decided it was a fake. Now they say I am liable to pay back the money. Also, a bank of employee told my boss about my account being over drown an he should watch who he hires that I would rob him blind an that I was a bad person. I consider this to be a breach of my confidentiality. Am I right?

Every financial institution is required by federal law to have a privacy policy and to make that policy available to customers. So get that policy and read it. Chances are it will have something in it that will make it clear the bank employee violated the policy.

What is the name of your state?

Any defamation claim you might consider would be against the employee who defamed you and not the bank that employs her.

Though if the employee violated the privacy policy of the bank the OP could file a complaint with the bank's primary regulator. That regulator can take action against the bank for violations. That doesn't get the OP any money however. The primary regulators are:

  1. For national banks, it is the Office of the Comptroller of the Currency (OCC).
  2. For banks that are not national banks but are members of the Federal Reserve, it is the Federal Reserve.
  3. For banks that are not national banks and are not members of the Federal Reserve but are members of the FDIC, it is the FDIC.
  4. For state chartered banks that are not included in 1-3 above it is that state's banking regulator.

Are you looking to sue the employee(s) or are you just interested in reporting the financial institution?

Because you are accusing an entity of violating the law, I am reporting your post with the name and location of the bank. The state name is all that is needed - or legally wise to publish here.

Its Mobile Alabama an I think they broke a couple rules not only told him but my Nephew went in to open account since theirs not many to choose from an the told him he couldn't an not to follow in mine nor his moms path we wasn't good role models

Do you know why these employees are speaking to others about you in the manner they are?

I think because one got in trouble for letting my sister deposit an cash check without my consent then wanted me to pay the 1700.00 that was still owed after they took the 600 I had in bank already I refuse to pay any for the fact I wasn't even in town nor gave permission thats the only thing I can think of

The bank employees are not being smart in talking about a bank customer as they have been.

You have a few options.

The first one you might look at is reporting the bank employees to the bank manager.

And you might want to consider changing banks.

After a review of the bank's privacy policies and depending on what you find, you can report the bank to the proper regulator.

You can also speak to an attorney in Mobile about a defamation and possibly an invasion of privacy claim, this if you feel your reputation has been harmed enough to make pursuing a claim worthwhile.

OK thank you I wasn't sure how to handle this situation now I can hopefully get it taken care of thanks again!!
