Please Help Me

I presently live in Virginia and just recently got a DUI. The night of my arrest they took me to the hospital for a blood sample. I did not have any drugs or alcohol in my system only marijuana which I take for SEVERE depression and ptsd but they still chose to charge me with a DUI. This is my first offense. I plan on moving to Maryland where medical marijuana is legal as long as I have a medical marijuana card. The judge restricted my license for a year and I have been court ordered to go to a Virginia Alcohol Safety Action Program (VASAP) in Virginia for the DUI of marijuana

Would I be able to transfer and take my classes in Maryland when I move?

Will I be able to take my marijuana medication in Maryland’s Alcohol Safety Action Program even though I had a DUI in Virginia for marijuana? Would they test me for marijuana?

Please help me. I do not do drugs and I don’t want to start taking the medications or pills they might prescribe me for my medical problems. I payed over $1000 in Virginia to get my license back a month before they pulled me over for having a license plate out.

I have a cousin who lives in Maryland and said I can live with him. I have a good job lined up over there and I am trying my best to get my life together.

You should speak to your probation officer and/or your attorney.

It is possible that the Court in Virginia will approve a transfer of your case to Maryland (if Maryland is willing to accept the transfer). But this is by no means a guarantee.

Even if you take marijuana for medical reasons, by the way, you still legally cannot drive while under the influence of the drug.

Thank you for your help. My lawyer was court appointed and it seemed as if she was working with them and wanted to find me guilty.
I hesitate to speak for your public defender but I can tell you that most defense attorneys work very hard for their clients to see that their clients get the best outcome possible based on the facts and evidence presented.

Even if Maryland allows the medicinal used of marijuana, they do NOT allow one to drive impaired. (EDIT: I see that Quincy mentioned this above.) Also, marijuana IS a drug, so the statement that you don't do drugs is not accurate.
