Prorated Rent

In my lease renewal agreement, the landlord noted that a prorated rent amount (amount was specifically noted) would be due on the first day of the month my lease renewed. They are now claiming I owe and billing me for the full month’s rent, saying that the prorated amount in the lease was a mistake. Can I refuse to pay anything but the prorated rent?

I really didn’t think anything of it, I thought it made sense because my lease started July 21 of last year. Anyway, they made a mistake and didn’t realize until they billed me and I told them my bill was incorrect. Do I have any recourse? I was only planning to pay the prorated rent since that is what the lease says is due on July 1.

No, the rent is still due on the first of every month. The prorated month, July has its own section saying that the prorated amount for July is due on the 1st.

If you had to pay a pro rated amount in the beginning such as in your first month then after that your rent was due on the first of every month so you never paid a pro rated amount again but did pay full rent every month after , I don't get your logic as to why you believe you owe do not owe a full months payment in July unless your lease ends July 21 and you have given your LL proper notice informing the LL that you wont renew and will be vacated by the 21. If you are not planning to move out and don't pay full july rent do you think there is a chance your LL will end up taking you to court for non payment ? I think there is a chance they might!

Do the amounts matter? I know that a lease is legally binding. My only uncertainty is around the fact that they call it “prorated” rent, and if that changes anything since I will be in the apartment for the full month. My feeling is they put the amount that I owe for July, and that should be the amount I have to pay - not the full rent which is almost 3x as much.
