My boyfriend has custody of our son who is now 6 and that's because I was stupid and gave him custody years ago. I want to break up with him but am afraid to cause he has custody which means I won't see him that much. I've been there for him since he was born and his dad hasn't done much. He don't feed him when I'm away, he stays upstairs in his bedroom for a good portion of the day while our son is downstairs. I'm not away often but I've been away enough to know that our son wouldn't thrive in his care. He calls our son names and his son from a previous relationship. How do I document this so judge will believe me? Do I have a chance to get back custody?

Please explain what you mean by "gave him custody"?

Do you live with your boyfriend? Did you live with your boyfriend when you gave him custody? Where does your son attend school (from an address you share or from an address of just one of you). What type of custody did the court grant your boyfriend? Why have you gone away? How do you know the child is not fed when you are away? How long has he called your son names? What type of names?

Since you have always lived with your child and the child's father it is no longer status quo that he has full custody of the child. You need to file for a modification of custody based on the fact that you have both lived with the child the child's entire life and that you have been the child's primary caretaker. You should ask for joint legal custody (joint decision making) and primary physical custody with whatever parenting timeshare you feel would be applicable.

What type of custody did the court grant your boyfriend? Why have you gone away? How do you know the child is not fed when you are away? How long has he called your son names? What type of names?
In addition to these questions - who attends parent/teacher conferences? Who takes the child to the doctor/dentist? Who signs school paperwork? Who signs him up for extracurriculars/attends? Who provides the majority of day-to-day care? How often do you "go away" and for how long? Who cares for the child when he's not in school?
