A family member has resource in overseas banks but it is under litigation

An elderly family member in India has resource that is worth more than 2000$ i.e. fixed deposit but she can not use it or access because there is a lawsuit against all of her resources including her home. She is aged and disabled/retired with no income. Can she apply for SSI even though her resources are more than ssi limits (because of litigation)

If she is living in India she cannot apply for or receive SSI. If she is living in the US and is a citizen of the US then she can apply for SSI but there is no guarantee that she will receive it because of the resources. If she is a green card holder then whoever sponsored her for the green card is responsible to support her.

What is your proof? What can you submit? How can SSA determine if your evidence is even valid? How long will her assets be tied up? How much is she worth?

Some non-citizens can get SSI. Most cannot. Anyone can apply. Not everyone who applies will be approved.

Since she is living in India she is not eligible for SSI benefits from the U.S. See the Social Security SSI eligibility page for the non-financial requirements she must meet. Perhaps there is a program in India that would assist her.

While some aliens living in the U.S. may qualify for SSI, the applicant must also live in one of the 50 U.S. states, the District of Columbia, or the Northern Mariana Islands to qualify for benefits. Since she lives in India she cannot get SSI benefits, and that is true even if she is a citizen.
