HELLO ME AND THE FATHER WERE NEVER MARRIED AND HE NEVER SIGNED THE BIRTH CERTIFICATE BUT MY CHILD HAS BOTH LAST NAMES . A PERTARINTEY TEST WAS NEVER DONE EITHER. HE LIVED IN ANOTHER STATE AND HAS NEVER VISITED WITH MY DAUGHTER WHO IS 10 YEARS OLD. HE JUST NOW STARTED PAYING CHILD SUPPORT AND HE IS ASKING FOR ME TO SEND MY DAUGHTER ACROSS THE UNITED STATES TO VISIT HIM WHEN NEITHER ONE OF US HAS GONE TO COURT REGARDING CUSDITOY. I WORRY IF I SENT HER TO SEE HIM I WOULD NEVER SEE HER AGAIN. WHAT SHOULD I DO AND HOW DO I KEEP IT TO WHERE MY CHILD IS GUARANTEED TO RETURN HOME IF I DID ALLOW IT??

Why would you allow your 10 year old to cross the country to visit with a man she never met before? Let Dad know that if he wishes to have a relationship with his child, to come to her home and meet/visit/get to know her. Go to court and file for visitation/custody before allowing visits in his state....that way if he doesn't send her back you have legal recourse.

thank you and basically he tells me that if i dont allow her to visit then he will be taking me to court to fight for custody. do you know if there will be fees for filing for a hearing for the visitation and cusdoty. i never been thru this so not sure the steps to take

Yes, there are filing fees. You can ask they be waived it you are low income. He will not win custody of a child he has never bothered to even visit until CSE went after him. He will be given a visitation order with a step-up plan so the child can get to know him. This will happen in the child's home state...not the Fathers.

You can get a referral from the NV Bar Assoc. The initial consult will be around $35/$45 dollars. The attorney can give you a pretty good idea how the visitation will be handled in your local courts.

BTW: Never listen to threats made by an ex. For the most part it is just bluster in an attempt to intimidate you.

Is he paying support through the courts via a court order? Or just sends money when he wants to? It matters with regards to paternity.

Please don't post in all caps. That is difficult to read and is considered as shouting.

You are correct that you should NOT send your child out of state to visit with her father before custody and parenting orders are in place. Tell dad that court orders will need to be in place before your child visits with him out of state, but tell him that he is welcome to come and get to know her under your supervision in the meantime.

Tell him fine. No judge is going to give him primary custody of a child who is 10 years old and has never even met him. Let him file the case.

Don't panic. You have received good advice from the previous posters. Be sure to get support paid through your state agency rather than checks from him. Follow the court orders to the letter and expect him to do the same. File for contemot when he does not. After being absent for 10 years, he does not need the chance to be irresponsible any longer.
