Can an administrator of a will be dismissed because of filing a false police report, has a gambling problem, been in a mental hospital for 30 days and attempted suicide?

An administrator of an estate can be replaced by the court if there is good cause to do so. The above reasons sound like pretty good ones.

Whether these allegations would rise to the level of being a good reason for dismissal depends on the whole picture.

For example, what is meant by a "false police report"?

What is the proof of the gambling problem?

The psychiatric help is not necessarily indicative of the person incapable of ethically and diligently fulfilling their administrative duties. If the suicide attempt and hospital stay was more than a couple of years ago, it may in fact be irrelevant.

Finally, I find your username, "fighting to get her" to be telling. Are you out to get the administrator?
 
while dating my father and living with him she was with 5 other men behind my dads back...she lied to him and said she needed money to pay a doctor bill...but actually she lost all her disability check at the casino. he gave her $2,000.00 and told her to bring back $1,500.00 but she also lost the 1,500 at the casino too so she stopped at a store and called the police and reported the she was robbed at gun point..stated that the robber took the envelope with the 1500 and ran..they found on camera that none of that happened..she was so upset after being released and sited a mistermeanor that she went and got drunk and took some zanax..so much so that they found her on the floor bleeding from the face..she told her daughter that she wanted to kill herself..so her daughter called 911 and they put her in a mental hospital. This was a year ago..the drinking..gambling..and drug abuse was noted on the hospital report...and YES I am out to get her for the things she did to my dad which lead him to his death...

How long was she with your father?

How old is the will?

You could consult with a local lawyer and gain some insight on the requirements to contesting a will. It can be expensive. How much $$$ is in question?
 
she was with him for about 5 years...she is 62 years old and my dad was 85.. his will was changed in September 2019 and he passed Nov 2019... there is $930,000.00 in question

Do you know if, other than her administrative duties, things were substantially changed?

What was your father's physical and mental condition at the time the changes were made? In particular, was he mentally competent?

While the estate wasn't super tiny, it also isn't millions. For perspective, a relative spent over $50K before settling when her step children contested their late father's will. (In this case, this was a multi-million $ estate, and the couple had been together for 15 years.)

I know it's hard, but determine whether legal action makes financial sense first.
 
yes they were changed...she was willed all his bank accounts and everything he bought after my mother passed down to a rug under the kitchen table... my dad had a stroke and was doing ok but as time went along he got worse...she then told me every time I spoke with her that she was tired of wiping his ass..cleaning up blood (from him falling) and having nasty sex with him...since my mom passed his mental state went downhill and then after the stroke it really got worse but the lawyer said he was good enough to make his own decisions

That she has done prior bad acts like making a false police report, gambling, whatever isn't likely to be relevant. If the attorney said he was good enough, it is the attorney staking his professional judgment that he was okay. From the sound of things, it's not likely it would be worth what it'd cost to contest, but you could talk to an attorney. Remember that during the time that she was wiping his blood up, wiping his ass, etc. she was probably keeping him from having to spend every penny of that estate to care for him in a facility or have caregivers at home.

Your posting is somewhat confusing in that you say she is named as an administrator, a title that usually applies (in many states) when there is no will.
Then you later state that there is a will, which would be handled by an executor, not an administrator.

Has the will been sent to probate court?

Does the will mention the wife as a beneficiary or has her name been left out completely?

If you have not already done so, you should be consulting with a probate/succession attorney to find out who gets what with this will.
 
there is a will and she is named Independent Administratrix with full seizin and without bond

the will is not i probate court just yet due to the fact that my dad didn't do my moms succession when she passed so we are doing my moms succession first then doing my dads. According to the paper work, my dad owes us a lot of money which his assets aren't enough to cover what my mom left us.

another question I have is.. if my moms will left me and my sister assets and my dad's estate doesn't have enough assets to cover what my mom left us..but willed the administratrix about $89,000 worth of assets..does she have to return what he left her to pay us?

The lawyer my dad hired is a flake and seems to be on her side...so I am trying to get as much information as I can so when I go for my next appointment I will have a little knowledge
