In that exact circumstance, no. But the details always matter, and change the details and the outcome may be different. The problem is that, when you make an appointment on the phone, there is no written contract. For example, let's say I'm assigned to a new doctor at enrollment in my insurance. I don't pick that doctor and I've never been seen by the doctor. I call and make an appointment and am never informed of and never agreed to a missed appointment charge. Should I still be on the hook for that charge?
