We are seeking emergency guardianship of our 3 month old grand daughter. Can we get a home study waived since we have consent from the parents and we are biologically related?

If the parents are willing to let their daughter stay with you, why do you need a formal guardianship order?

So, is CPS (or whatever it's called where you are) involved?

You don't need a home study if all that is involved is the parents voluntarily giving you guardianship. However, if CPS is involved they are not going to let you out of the home study.

What is the emergency? Is CPS involved? Why do want the home study waived? Are you trying to expedite the process or is there something or someone in your home that would jeopardize the placement?

Do you have a lawyer?

You are going to need a lawyer if you are seeking to get something waived.
Oklahoma uses a standard of best interest of the child, so parental consent and blood / family relations don't directly impact that.
