btw, will debt collector help in this case? Not for a $300 debt. Your best bet is to wait him out, unless he owns the second rental property free and clear, then maybe it would be worth the hassle and expense.

i don't know where to check, but from sdat website it looks like he paid off his investment property in 2019.

It is not a do it yourself project, and I expect it will cost you more than $300.00 to sell the property under your lien. While your costs would be recoverable, you would have to advance them, your attorney's fees would not be, and I expect they would be several thousand dollars.

but when to factor in that 10%. at the final collection when he sold his house?
When you are asked for a payoff amount to clear your lien. You can add it daily, weekly, monthly or yearly, but what is the point, do it before you get paid.

Right 10% simple annual interest.
thank you guys for all the help. I was simply frustrated after bring this small claim to court. i simply want to get back what I was owed, the $300. nothing more than that, although I know MD allow 3x of that money be requested. But after numerous trip to court for hearing and filing, I really feel that 3x is a reasonable amount given the time spent. But also our legal system is still less than perfect, defendant still has a lot of freedom and space to run away, even he should and capable pay back all he owed me.
