We recently discovered that, when my daughter was arrested in Dec., her step-sister went to her apartment and took her purse and several other expensive items. When my daughter received the $600 stimulus money for her and her 2 children ($1800 total) her step-sister used her bank debit card to spend the money. Last week my daughter tried to file charges but the officer she spoke to said, even though the purse and other items were stolen in the county my daughter lives in and is incarcerated in, because her step-sister lives in another county, my daughter will have to wait until she gets out of jail and file charges in the county her step-sister lives in. Is this true or are the police refusing to help her because she won't give statements against the other people who are involved in her case?

Only the police can answer the question of why they refuse to investigate. Typically charges would have be filed in the county/district (or however courts are organized in that state) that covers where the crime took place, not where the defendant lives. However, parts of the investigation could be done in either place, and to the extent they need to search the step-sister's home or whatever, that would have to be done where the step-sister lives. Nothing prevents you from making a report where the step-sister lives to see if they will do anything. And, of course, your daughter can sue the step sister for the value of what was taken.

Does your daughter have renter’s insurance (or did she at the time of the theft)?

If your daughter is still incarcerated, how did she learn of the theft?

Who else is involved with this theft (not real names) and why doesn’t your daughter want to include them in a theft report?

Thank you for adding that. The insurance potentially will cover the other items taken.

I think I misunderstood the original post. JLAVG apparently is choosing to stay quiet about those who were involved in whatever crime she committed that resulted in her incarceration. That shouldn’t affect any report to the police she (or her mom) makes on the unrelated apartment theft.

It makes no sense. However, if the police in the city/county where the alleged crime occurred are refusing to do anything, then it's true.

Good points - although I suspect the daughter has no lawyer currently.

And I always like the state name of posters, if for no reason other than to provide local resources where answers to any questions they might have could be located.
