I owe back in child support about 39k. I lost my job 9 months ago and have been in rehab. I am currently looking for work and paid all payments in full for 4 years before this happened. There have been no charges against me and the custodial parent does not want to press any charges. Will the courts file anything? Have you been receiving any notifications about the matter from the state? The courts won't file anything on their own, but the child support enforcement agency might do so. If you have been in contact with them and they are not forcing the issue right now then there is unlikely to be any court activity at this time. That doesn't mean that they will let it go on forever though.

True. I am currently looking for work and had not been in this situation. The state has not contacted me about the matter. I am borrowing money to make at least partial payments until I find a job.

Then don't borrow trouble. Keep doing what you are doing to try to make at least partial payments and put it on the back burner until you get a job or until you start getting threatening letters from the state.

I have only received the bills for the past due amount. It does say that they will garnish my checks, which they have already and about tax returns and so on.

I think what you're saying here is that your ex is willing to forgive your failure to pay and currently intends to take no action against you. Correct? If so....

The court isn't going to care unless someone (either your ex or the district attorney's child support enforcement unit) asks the court to do something.

Ok...and? If this matter is being handled by the district attorney's child support group, then they may take action regardless of your ex's willingness to forgive the non-payment.
