I have a few problems with our local schools.
1) A student accused my daughter of smoking and having Cigarettes in her purse. The Vice-Principal called me in to talk about it, although they found no cigarettes and the girl that reported it admitted she did it to get my daughter in trouble. The school vice-principal suspended my daughter anyway (he was mad at me for continually reminding him he had no proof of any rule breaking, to the point he was yelling and calling my child a lier and we walked out on him)( the school super reversed the suspension decision)
2) On 1 occasion a teacher had refused to let my 14 year old daughter use the bathroom in an emergency. (According to the school handbook they can if it’s an emergency) As a result she ended up bleeding in her pants. I had been told by the super and the principal it will never happen again, yet I have heard of it happening with that same teacher a 3rd time in 3 months now.
3) The school has a in-school policeman that monitors cameras around the school, some even in the bathrooms and even pointing in the stalls. (Isn’t this child porn, if it would be on my computer I’d be raided by the FBI for child porn, but since it’s a cop watching it, it’s legal?)
4) and the main reason for this post.. My daughter was held after school and told she could not leave until she told the teachers and the schools social workers the whereabouts of a runaway child.
My Questions are, are these standard acceptable/legal school practices? Are there any points on which I would have a case? Could I distribute a paper outlining basic student rights, encouraging other students and parents with similar stories to contact me to try to get a larger group to sue the school district over questionable practices? What are the legal problems I would need to avoid if I want to post these stories on a website dedicated to these school horror stories?
On point 4 the principal told me he felt he was within his rights to detain my child and will do it again if the situation arises. My understanding is since this had nothing to do with the school, school property or school events, they had no right to detain her after school hours. (Approx 1 hour after school) This should have been a police or social services matter, not a school issue.
The principal NOW claims she was never held against her will, she could have left at any time, even though my daughter told them several times, before and after the bell rang that she had to go right away after school to a family event, he claimed as soon as she said she had to go they let her go. A clear lie to protect his job.(he was not even present at the questioning so how can he say what happened) He also suggested that the police were involved, although when I asked where was the police during questioning. He said they were busy and not there. If he was acting on behalf of the police I thought he was required to read her her rights. ( I have a call in to the police to see if they had indeed contacted and asked the school to do this)
Although I realize suing will not get much of anything, the conditions at this school are worse then any US prison (they let inmates use the bathroom) and someone has to get them to START obeying the law or at least make them understand that children have rights too.

I had talked to the police and they have told me they had nothing to do with this and the runaway child had turned herself in the night before, and her mother was picking her up (after driving hours from the upper part of the state) at the time my daughter was held and questioned.
