Do you have a cite for that? The data is presented a bit differently at http://www.pewresearch.org/fact-tank/2017/03/28/federal-criminal-prosecutions-fall-to-lowest-level-in-nearly-two-decades/
With more raw data, I struggle to make a link between Manafort and the incredible awesome job the...
I'm not sure if he deserves the punishment he will get, but it seems pretty clear he is guilty of LOTS of crimes. The tax fraud ones seem the worst to me. The lobbying ones I am more ambivalent on. We have so many process "crimes" now its hard to really see how to tell if someone is doing...
I'm not anti-legal pot. I support medical and think the benefits far outweigh the costs. I accept recreational even though I believe it will have many negative effects on society. The reason is more ideological. Freedom has benefits too.
Then, what are you arguing? Was it a patent danger or was it a latent danger or was it not a danger?
I can't post the whole case. There is not a holding in my favor that points to a resolution. It is posted so those interested can see the issues in this situation.
Basic word use. It's why I put the definitions of words in a previous post.
Are you arguing the danger was patent or the water was patent? It makes a difference.

It makes perfect sense to me that no one on pot is a better driver--even if they think they are. It also seems reasonable to think being under the influence of pot diminishes their ability to drive safely.
Why can't we get clear evidence of that?
There's a statistical study out there much...
I know. I thought by defining it you would see the issue.
The danger is water damage to the tenant's property.
The latent part has to do with your statement of how the water never created a problem in the tenant's past.
Latent: (of a quality or state) existing but not yet developed or manifest; hidden; concealed.
Danger: the possibility of suffering harm or injury.
I agree it can be argued as an act of God. But, just as changing the flow of water to your neighbor can result in liability, it can also lead to...
A wise young person might try to find out what his boss likes and act that way. For instance, there is little (of normal-type day events) I hate more than when I'm busy and someone comes into the office with a question. Not just a question as I don't mind that at all. It's when they don't know...
I don't think the standard for land owner liability requires a standard they knew of the problem. In many states, they also have the duty to invitees to make a reasonable inspection to find latent dangers.

(I assume you meant there is [no] per se level of metabolites that proves impairment.)
The actual problem is that it increasingly seems there might not be a per se level that proves impairment. Right now, the best I'm seeing is that THC levels drop rapidly so that anyone above a certain...
Re-read my post. I'm sorry you did not understand what I wrote--it is clearly my fault. I'll copy it here:
I once had a (young[ish]) worker come in to me an ask why I was so angry about a task I asked clarification on regarding a job I had him do. I asked him over text. Since I had no anger at...
If you are texting a young person and refuse to acknowledge he is going to react in a certain way to your message, then you don't really want to communicate what is in the message, but some overarching theory of the way things should be--rather than how they are.
He's a wonderful employee. He...
I agree. The communicator failed to recognize many who answer here are old and have a completely different contextual existence and something that might seem obvious to a high school kid is not so to those who remember Casey Kasem countin' 'em down. (While knowing he was counting them down.)...
We have not established they "don't know" but that they don't use. If they have no desire to know how their message is being perceived, then they have no real desire to communicate. They just want to hear themselves.
Of course it goes both ways. For instance, some might think a young person who doesn't use punctuation or spell out words completely and correctly in a text is barely literate when, in reality, it is just the style of the times. It is on the one(s) who want to communicate to determine hidden or...
Show me the study that scientifically links bloodshot and watery eyes with impairment. Yet, that is going to be in most any testimony of the officer in court on a DUI.
The whole point of all the signs we look at and tests we run is because we cannot see into a person's head to tell if they are...
