I believe Executer unlawfully accessed bank account. Can he be charged? What steps to take to remove him as Executor?
No crime happened, or at the least nothing happened where the police would want to get involved. Accounts can be co-signatory versus co-owned, which results in different actions when an individual dies. The BIL could certainly claim this was the case. I’m not even sure if death legally freezes...- Foamback

Discrepancies between written property descriptions and monuments of all sorts is an ancient issue with not one simple answer. It would seem that the OP would get a survey and sue the cemetery for its cost- Foamback

The cemetery says the plot as described doesn’t exist, that the actual plot is somewhat different, and the OP claims the physical plot somehow does fit the original description based on measurement...- Foamback

But getting the plot as per the larger dimensions may not be possible if the adjacent plots are occupied. The plot they have is the plot they are going to have. In my state Washington, a plot is bought with included maintenance in perpetuity. I’m going to guess that applies to California also...- Foamback

My question remains. The OP stated his dims matched the contractural description. So the question becomes why the discrepancy? In a cemetery dating to 1852 are there any monuments internal to the cemetery that a surveyor could even come up plot locations without the OP spending tons of money...- Foamback

Screen Door – HOA now requiring
First of all, if it’s a condo, who owns the exterior of the building? I would assume the association does. If so, they can put a screen door, but they pay for it. second point. Can developer force us to lend the side yard for their constructions?
I doubt there could be court enforced construction easements. Every zero setback I’ve been around was built to be no maintenance, and the walls end up being a foot or two away from property line, after the trench, trench protection, footing drain and the foundation atop all that.- Foamback

A 1 1/2 to 2 year residential project is not the norm. We used to do five story wood frame on top of two floors concrete parking and commercial use in about ten months.- Foamback
