What is the name of your state?What is the name of your state? Involves West Virginia and North Carolina

What is the law regarding student and teacher relationships where the student is neither a student of the teacher in any way nor is she at the same school as him? I have a fellow teacher that is 27 that is dating a young lady who is 16. They are both in love with each other and are NOT having any sexual relationship according to them. Her family is also very accepting of the relationship. With that said, what are the laws regarding a teacher dating any person younger than 18? Thank you in advance for your help.

Unfortunately, the relationship is not a crime.

I can only hope the school board finds out. This is one teacher who doesn't need to be in the classroom.

Thank you for your response, Breeze. I do differ with you in my assessment of the situation... while it IS kind of strange... especially until I got to know both parties... but my question (legal) is this.....
If there is not crime being committed (re - sexual relationship) and if her family approves...
What could the board do? Would it be a dismissal on grounds of immoral behavior? Could they do that without it being explicitly written into their regulations?
If it matters, the teacher in question works with younger students and not at a high school.
Thank you again for your input as they are both asking me for advice.

Since she's 16 it must be okay. Oh, my God! You are a teacher, "I have a fellow teacher," and you are justifying this!!! Oh, my God! If this is not against your laws, I can only hope there is something in your contract, and I will bet there is, and you both lose your teaching positions and certificates. She is a 16 year old, and he is a high school teacher. Did you happen to leave out, "By the way, she's mentally retarded, but they are just so cute together!" or "I forgot to add, they have been dating for 5 years, and I think their 3rd child due this month will have his eyes." Oh, my God! Wait, West Virginia; I take back everything I said. It's okay.

This is a teacher, an adult, dating a 16 year old. Teachers are in positions of authority. This is not tattling to your mom that your brother took your comic book. This is an adult, a teacher, responsible for educating CHILDREN, and she is one, and he is dating one. And if you think they are only holding hands and watching the Disney channel, you are an idiot, and I don’t mean mentally retarded. I know people who are, and they all know this is wrong and a crime in many states. I sure would feel comfortable to have my daughter in his class. This has nothing to do with friends. Itsacatsworld, Are you 12? Better yet, are you head of their teacher’s union, or both?

Thank all of you for your responses... however, some of your comments are not only unnecessary, but also have no direct bearing on the question... if i were asking for that I'd do it in an MSN chat room. With that being said, the case with the female teacher involved a sexual relationship... my question is that IF they are not having sexual relations, what criminal law is being broken? If none, then on what basis would a school board have for dismissing a teacher? Thank you again for your responses.

I am so excited. An individual from the State's Depart of Ed. General Counsel's depart has been in contact with me. I'm adding the info you stated in case it's needed in the case that I hope is being developed. I'll be call her tomorrow and let you know if anything can be done with this case.

Not only is that WRONG, it is also not on point. The LAW does not change from school district to school district. Only how each district handles internal corrective measures.

As for what can happen, that's an internal matter with the school board.

BelizeBreeze, did you read my last post? I contacted the State Department of Ed to report this thread. I didn't do it so that he might get the "best friend" award. I asked about which district because I thought that he might just be dumb enough to tell us and make the state's investigation easier.
