What is the name of your state? Maryland

Hi. I have joint (legal and physical-- kids spend 1/2 with dad and 1/2 with me) custody of my kids in Maryland. I want to move to California, where my family is and where there's this great job. I want to petition for sole custody, but my ex will make it very difficult. It will be a long court battle and I can't wait that long. So if I left Maryland with the kids, what is the worst that can happen? Would I really go to jail? Would the kids automatically go back to Maryland? How can they find me in California?

When you finally move to California, I hope you'll seriously consider leaving your stupidity in Maryland. Someone else might need it.

IF your ex is not as IAAL suggests ( and I wouldn't bet against him ) the can you say Parental Kidnappping and Federal Prison?

Is he harming HIS kids when they are with him just as much as they are with you? Is he not feeding, clothing and putting a roof over their heads when they are with him just as much as they are with you?
Is he verbally abusive to his kids when they are with him just as much as they are with you? Is he out drinking and fighting when his kids are with him just as much as they are with you? Is he bringing home women and having sex right in front of his kids when they are with him just as much as they are with you? Is he not paying the bills for his kids when they are with him just as much as they are with you? Is he bad mouthing his kid's mother in front of them when they are with him just as much as they are with you? Have his kids specifically expressed to anyone that he is a sh*tty dad and they are afraid of him and never want to see him again?

I dont think this person is into hints. Jail cells with orange pantsuits seems more their style?OP yes the state will find you or the federal government will find you or a dozen other people or you will turn up on America's Most Wanted. Quit being a selfish idiot. If you want to move to CA move there but leave the kids with their other parent.

No....if you have Joint Legal Custody ...you can take the child or children. Your ex may try and do something when you arrive in Califorinia, and then you can have a custody battle. But you CAN take a child and go. That is not true that it is kidnapping, etc.... In VERY FEW states is anything done at all, because it is legal. What your spouse does to try and go through the court and get the child after...well, that's another story. But you will not be arrested or anything else..You do not have to get permission to move to another state with your child.....When you get to California, IMMEDIETLY go and file a paper with a lawyer stating residency that your lawyer will send to your ex.

It's illegal. What are you gonna do, take your kids on the run and deny them their dad to boot?
