No....if you have Joint Legal Custody ...you can take the child or children. Your ex may try and do something when you arrive in Califorinia, and then you can have a custody battle. But you CAN take a child and go. That is not true that it is kidnapping, etc.... In VERY FEW states is anything done at all, because it is legal. What your spouse does to try and go through the court and get the child after...well, that's another story. But you will not be arrested or anything else..You do not have to get permission to move to another state with your child.....When you get to California, IMMEDIETLY go and file a paper with a lawyer stating residency that your lawyer will send to your ex.
Do you think you could stop giving advive? You have no idea who's lives you are playing with. You are WRONG, seriously WRONG.

Hey dumbass. Because you posted ONE question on here, you think you are qualified to give legal advice? This is the second post of yours you've responded where you have been dead wrong.

Hey...how about backing up what you're pulling out of your fat ass with citings of state statutues and/or case law.

Summer,
Are you an attorney because you don't seem to have a clue. IT IS TRUE about it being kidnapping if she takes off with the kids and dad objects to her moving the kids. I see that you keep posting RAH RAH stuff but the posters do NOT need cheerleaders. They need facts.

I have an Idea...Why dont you try talking to dad about what you want to do? See if you can come to an agreement on visitation when you or if you move. If you move and not tell him you will be in trouble, no matter what you have joint custody and if it is through the courts you have a court order and if you break that court order you are breaking the law therefore you probably will be arrested. Also if you are going there for a good job and unless you are going to be working under the table then they will beable to find you. I would just talk to dad see if you can arrange something like summers and school vacations for him. If he doesnt agree then you need to go to court and get the custody ammended, most judge will consider the fact that you are getting a better job. Good Luck!

It doesn't matter if she has sole custody, if she removes the kids from the state to move (across country no less), dad can have her ORDERED to return the child/ren. If she fails to comply, she'll be she'll be wearing one of those orange jumpsuits Ohiogal mentioned.
