I got a phone call from my landlord the other day telling me that she has prorated my rent for this month and to only send half the rent. I sent the full amount. If she returns the rent check what should I do? I also filed a complaint against her for her discriminatory remarks she made to me. I sent a letter by certified mail which I'm sure she will receive Monday or Tuesday, if she calls me at work which I am sure she will do, should I refuse to speak with her.

Guees you will all have it out in court...sounds like that is the best place to finally put her to rest!

Well, I had decided to ignore this thread since 'djdj' had been spouting is inane drivel, claiming that everyone was a communist, or rascist, or KKK. However, after finding his latest post of lunacy, I felt that I needed to offer you some REAL, ACTUAL, Correct information so that you can handle this situation that you find yourself in.

I offer the following:

1) There is an online Maryland Tenant-Landlord handbook that seems to answer all of your questions in a factual way. And it very specifically tells you what your landlord MUST do to affect an eviction. It is located at:

2) The Maryland court system also has an online pamphlet (in PDF Adobe format) which can be downloaded at:

Hopefully, by reviewing what your LEGAL rights are, and not listening to this 'djdj' dweeb anymore, you will find that the landlord CANNOT just terminate your lease by saying so. Also, that by paying your rent late, and paying the late fees in accordance with the contract (lease), the landlord waived any rights to claim breach!!

You have every right to tenancy for the full lease term, or until you breach the lease. Further, in case of breach, the landlord has SPECIFIC legal processes that they must comply with.

Now, tell that 'djdj' to leave you alone... it sounds like you have enough work just handling your landlord!!!

I want her to take the landlord to court and maybe a racial discimination charge could make her some money, from a civil lawsuit.

You have a landlord who really does boarder on a commie,KKK, and a redneck low life, so they will stoop to nothing to make this womans life miserable.

we are all on her side....

Obviously, you have absolutely no experience in any of these events. And you appear to be a strong advocate of everyone suing everyone else, even on frivolous grounds, with the intent of making "her some money, from a civil lawsuit" your entire message thread is suspect.

First, you should understand that any actions that you proposed will do far more damage than already in place. Unsupported claims of rascism, communism, KKK-ism, etc. would be clearly denied by any court that even went so far as to hear them. In fact, the chances that these claims could even be filed 'Pro Se' are between slim and none, an attorney would be needed to litigate these claims, and NO ONE would even consider taking these on a contingency fee basis. This would leave the tenant in a position of accusations and threats of legal action that clearly cannot be done. Not only would this undermine the tenants entire status, it would certainly go a long way to cause further turmoil in an already nasty situation.

As even you should be able to see, your entire 'fight them at all costs' philosophy would do far more damage than good.

So, with all due respect to 'djdj', leave this subject alone and go back to the http://Idon'tknowanything.com or http://iamanidiot.com websites where your 'special insights' could be more appropriate.

Oh, and don't try getting into a battle of wits with me on this, I refuse to fight against an unarmed man. Have a happy day!!!

And to "living in md", please read my last post and research what your TRUE rights are. Then, with that knowledge, you should be properly prepared to respond to your landlord. Finally, I believe the chance of your getting a renewal of the lease is very slim, so please don't wait until your lease expires before searching for a new place to live.

this is scumbag behavior at its worst!

And as an American i am totally offended by this landlord..and she should be banished from this country.

but since we cant do that a big lawsuit is whats right.

It is very easy to pretend to ride in on your white horse and to 'threaten' to take on the 'bad-guys' (you seem to have left your guns and bullets at home!!), but it is ENTIRELY something else to actually do it!!!

If you are so insistent that someone else fight the battle that you are so ardent about... I assume you are willing to pay for all of the associated legal fees and hassle. If so, step on up!! If not, then don't try to provoke others to fight what is so clearly your own FALSE 'flag waving patriotism'!!

In reviewing your posts (and running across several others of yours), you seem to have misunderstood the purpose of this forum.... it is the free ADVICE forum, where people who have legal questions and problems (real or perceived) can come to obtain REAL, logical, practical ADVICE on how to best solve them. It is not a forum where every persons problems arise from ghosts, communists, rascists or KKK-ers as you seem so intent on stating (a LOT of your posts seem to take this same theme).

At this point, I feel that 'livin in MD' has had her questions answered PROPERLY and accurately. I will now devote my 'spare time' (??) to others.

Oh, 'djdj', by your response, it is evident that you are still unarmed (and no, that has no relevance to "The Fugitive").

After reading and checking your posts I have found that mylandlord charged me 10% of my monthly rental payment. Any advise?

You still have a vaild legal lease, and if that landlord wants you out she has to convince a judge.....and a judge will issue the order

but for this......it would be outrageous if a judge evicted you for this,

Always remember untill that judge say you have to leave, no one can tell you otherwise.

So if she has new tenants coming in....well the new tenants will be able to sue the landlord for all their damages too.

Just wanted you guys to know that I read all of Maryland landlord tenant laws. I actually found some laws that my landlord had broken. I sent her another letter stating that I was in compliance of my lease and that I would not be leaving the premises. I made her aware that I had followed up on Maryland landord tenant law. I received a letter from her today stating that she would have to tolerate me as a tenant until she could accumulate enought legal documenation to convince a judge to evict me. Of course this means that I have to watch all my p's and q's and that I will be sending all rent payments via certified mail. But I also stood up for myself and without the help of both of you guys I may not have had the legalities and the confidence to do so. Thanks for all of your help.

GREAT......thats what this is all about, not getting stepped on...

And this is why i say the things I do, it would be so easy just to search the state statutes and post them....

But YOU are the one being evicted, and how do we get you to think about your rights as an American, and now as a tenant?

This banter is usefull, because just about everything is listed in the state stautes, and those that are not, usually a judge would err on the side of common sense.

Now you found the laws, spend time reading them, it outlines what procedures the landlord and you must follow if there is a breech of the lease.

And every state is different.....not by much but different.

This is probably the best you could have hoped for is to stay untill the lease ended, and hopefully she will give you back your security, so she can finally get rid of such a bad tenant....LOL......

So i guess its time to save money, for the move, and sell what you dont need to raise cash, and hopefully find a much better place and landlord...and who knows a cheaper rent to boot!

arch, i was going to let you be. Did you read the post???? I won. She didn't have a case. She harrassed me. She's trying to harass me more by not cashing checks I send to her. People like you shouldn't be able to own anything. All of you should be reported.

Good luck, in getting your sercurity deposit back too....hmmmm another court case.....
