OK. Search is entry and physical manipulation of the structure or its contents.
wrong again.
Seizure is of property not a person by detention.
Wrong again.
And a citizen is secure in his home when a cop, without reason, justification or cause, pounds open the front door and gives orders.
that depends on if this 'cop' was a member of the force and in uniform under official duty during the knock or a private citizen or a member of the Village People.
I was really hoping for a citation of code and section with reference to the actions of a sworn police officer but it looks like I'm in the wrong place.
Yep, sure are. We don't do your legal work for you. And since you KNOW already that you are right, then I figure you can find out for yourself.
Perhaps the "law" isn't as black or white as I have imagined.
There you are RIGHT. Sometimes it's japaneese, korean, mexican and even a few PRs mixed in.
This is my first experience with a psycho neighbor/cop and the law both civil and criminal.
I HIGHLY doubt that. And I bet your neighbors won't say the same.
I can guarantee you that this is bizarre and completely unacceptable human behavior.
Yes it is. so when are you going to stop.
Additionally, this personality CANNOT stop a mostly childish harassment campaign.
Again, you are correct. So when are you going to stop it.
That's OK for people in most walks of life but it is absolutely UNBELIEVABLE that this nutjob would be a "sworn police officer."
And what line of work are YOU in?
In this process I have met some great ones who, I'm sure, would be offended to be associated with him professionally.
or with you.
It would be embarassing. I asked an aquaintance once why he thought about becoming a policeman and he said he wanted to HELP people. This cop wants to BULLY people.
Really? I guess you should know about bullying :D
P.S. BB, what are you compensating for, a small penis or diminuitive stature?
The only way to find that out is to bend over and grab your ankles ;)

Carl, EXACTLY the point. HE WITNESSED NOTHING. His wifey/neighbor (she has been screaming in front of our house twice) told him the people next door made a left turn in front of her that she didn't like. She provided no witnesses, evidence, skid marks or damage of any kind. Both of them are inclined and have harassed us for seven years. She got a case of road rage and ordered her big cop (actually that's the source of his problem - he stands about 5' 5") husband to come over and do something. He should have taken a license number and called the local LACSD. They could not prove anything approaching a crime on the part of my daughter's friend. He was not cited or detained by LACSD. I can give you a "book" of documentation, photos, letters, signed contracts etc., etc., that irrefutably demonstrates and PROVES an ongoing campaign of harassment. His agency SUSTAINED 4 counts of a complaint. I'm trying my best to show that this had nothing to do at all with good or effective police work. At this writing, I just discovered a type of oil thrown, from his property onto some concrete in my side yard. I have the video if you'd like to see it. Being right next door it is not possible that this oily substance came from any other source. He just threw something over the fence this evening. He had a bad reaction to his agency sustaining the complaints against him. The day he pounded open the door, he became so frustrated at the LACSD Deputy that ultimately responded, he called him a "prick." That is a fellow Deputy Sheriff (different county). I simply fail to understand how the behavior I've described here would be desireable on the part of a police agency or LEGAL. It certainly violates my concept of protection against unreasonable search and seizure and appropriate and legal officer activity. Maybe if we take a different perspective we'll come up with a different answer. What would you do; what would you think correct if this happened to your 21 year old daughter and her friend and his brother while you were out of town at your home? P.S. This was not an innocent mistake on the part of a well intentioned officer. This was a deliberate act by a neighbor harassing another neighbor under the color of authority without probable cause. Some LAW MUST have been broken.

No one here has condoned the type of activity you describe. But, it has nothing to do with a 4th Amendment violation as he was not a state actor at the time of the act.

If the local law enforcement won't take action, go to supervisors, administration, and to the DA. If none of them will take action, then you may have to hire an attorney to take some kind of civil action against the neighbor. Lacking that, then maybe you should yell to the media.

Sorry, that's about all you might be able to do if the local gendarme aren't gonna take action.
