An update.
I have been in touch with his insurance company. Their adjuster came out to inspect the car.
The agent from his company spoke to me as well as the supervisor. I wasn't happy with the decision.
It was a 50/50 split.
After I gave her the full story again.... she said in so many words that she does actually believe my story. Since he produced a witness that they actually spoke to, they are not able to pay for the damages at 100%.
The crazy thing is that the witness is some random woman who was sitting at a random window. Remember that he called over 3 young kids who practically jumped into his car. The 3 kids and Mr. and Mrs. than came out of the car and walked to the hood of the car to start writing notes. This is what I emphasized to the insurance company and that this looks as corrupt as possible. I suppose this is why she believes me!!!
Since she does believe me, she suggested I go thru my insurance company and they will go after his insurance company and perhaps into arbitration where she feels I have a better shot at having them pay the bill 100%. I spoke with my insurance company and they will be getting the phone number of this so-called witness and question them. I begged my insurance company to ask how they are connected to the 3 kids that were in the man's car.

BTW.... I did take it to the body shop and the estimate is $3500. Ouch!

I got my truck back from the autobody shop. Paid my deductible. Called the insurance company to see where they were in regards to getting the money back from his insurance company. The agent from my ins. company tells me that his witness to the accident has chosen to remain anonymous. Well, she sure sounds credible LOL. If you recall ... the 3 kids that were pulled into the mans vehicle were supposed to be the witnesses... maybe it's one of the kid's mom... This will be interesting. No doubt this will go into arbitration and hopefully they're smart enough to see right thru this that it's a bs story coming from them.

Update!!!! I won the case. Got my deductible back and his insurance paid the rest back to my insurance company.
Wonderful.

You can thank the stupidity of the other driver for your win. All he had to do was sit in his car, keep his mouth shut and wait for the police. In the absence of unbiased witnesses, the road conditions and the position of the vehicles would probably have resulted in you bearing all the fault, as unfair as that might sound.

When he acted suspiciously, his credibility evaporated.

Did you get a dash cam?
