But this gets into some odd territory for you. Rather than go this route where you may have to sue either the guy that hit you or possibly your own insurance company, why not make the claim under your comprehensive coverage of your policy? If your insurance company argues it wasnt accident damage, then argue it was apparently done while your car was parked somewhere without your knowledge and as such, covered under your comp coverage
Or if they argue it isn't covered under comp because they want to consider it collision damage, then under your own collision coverage.
