If adultery is a crime. whats the punishment? Jail? Prison?? Deportation??
It's not a crime (outside the military). But, there are many reasons why an adulterer may not be fit for employment in certain fields and may not be someone that an employer can trust. Hence, the reason why it MIGHT result in someone not getting a job if the pre-employment background goes deep enough.

Actually, in many states it still is. There was a lot of legal discussion on the topic after Lawrence v. Texas. But, while some theorize the holding would apply to all moral sex crimes, it would have to overturn many holdings that laws against adultery are Constitutional. It was more the disparate treatment of the sodomy laws (seems like only gays were arrested/charged) than the privacy issue that decided Lawrence.
