Advice...Help in murder case

What is the name of your state? Missouri. Hello, my son was murdered as he slept across the hall from me. Offender was put in metal hosp. After 14 years he was said to be ready for trial. Prosecutor said he had it in the bag, he'd probably die in prison. A few months ago defense stated they were using NGRI with no responsibility. He knew what he was doing just a few days before he threatened my son and me too. Prosecutor says he will go into mental facility and stay there. I don't see this happening as he is component. There's nothing else I can do, I have pled with prosecutor. My questions are 1we have been told to address the judge, what do I say, how important is this and what can it do? 2. Can a huge make the decision as to which facility the offender goes to? I want him in a mental prison if Possable. 3. This goes to court June 20, will it all be determined and finished this day? I thank you,.

If you will be providing the court with a victim's impact statement prior to the offender's sentencing or proposed transfer or release, you will want to clearly state for the court all of the reasons you believe the offender should be in, or should remain in, the custody of the State. Courts tend to give a lot of weight to the statements made by victims.

Beyond making your wishes known, there is nothing you can do. You have no control over in what facility the offender will be housed.

If you have the means, consider to hire your own advocate (a lawyer) to assist you.

Although many of your goals may be aligned, the prosecutor is not specifically your advocate.

You deserve to be heard on your own terms.

I'm sorry you are facing this pain. Good luck and be strong.

Thank you for your reply. Yes I know I have no say so where offender goes, I was wondering can the judge say which facility he goes to

In Missouri, the Department of Corrections has "diagnostic centers" where offenders are sent after sentencing.

The offender is processed, evaluated and "scored" according to the type and severity of his/her offense and the imposed sentence and other factors - and will be housed in a facility based on this assessment.

He won't be going into the Dept of Corrections, will be a mental facility, since the Prosecutor is excepting the NGRI pleas with no responsibility. He has been found component since a year ago. Now the best I can hope for is a type of mental prison

So the offender is now deemed competent to stand trial but his defense to murder will be not guilty of murder by reason of insanity?

You might want to take the advice offered earlier and get an attorney to help you draft your impact statement.
