I just talked to my lawyer, and he said that often the sales price is increased to absorb the extra costs to the seller. In my case, since they're getting a 100% loan, it would have to appraise for more than the selling price in order to do this. I know it appraised for the right amount, but I don't know if it appraised for more. I guess I'll find out soon enough. Looks like contracts will be signed this week.

The main issue is so dumb - the jerk is being very difficult even though he's going to be getting all this money. I'm still paying for his utilities, because the realtor convinced me to not cut them off when I moved out. The jerk brought in a lot of stuff from his past job - tables, cabinets etc. Now he's saying he wants me to pay for half a dumpster to get all the stuff out of the basement - when NONE of it is mine and I didn't bring any of it in. Everything that I brought into the house is now out of the house, and he still wants me to pay to get more junk out. On top of that, he won't dismantle the large cage, which would take him approximately 40 minutes of his unemployed time, and he has the tools to do it. Finally, the water needs to be shocked, but he hasn't tried to contact me about doing that, or paying for it. Hopefully my lawyer will be helpful in resolving these few dumb issues. Thanks again.

Hello again! I hope you're well. I just wanted to post an update and a quick question.

The contracts have been signed (finally) and the date is set for Nov 21. The dumpster issue has not been resolved as yet. My lawyer tells me the jerk actually got a job and has held it for a whole week so far.

Now the question: the payment for Oct is due Nov 16. Closing is set for Nov 21. I was a little nervous about having to pay, since it's only a week off and I don't really have the money (I could borrow it if I had to though). My lawyer told me that he can file a 'perdiem' (sp?) so we didn't have to pay this month's payment. I just wanted to run it by you and make sure that it's a legit thing to do. Thanks.

Also, the septic needs to be cleaned. If the buyers won't take the money to do that at closing, I'm going to front the money as the jerk has none. My lawyer assures me I'll get that money back at closing (or half of it at least).

I'm just throwing this out there so if anyone thinks of anything, has opinions or advice on any of this I would be grateful to hear it. I do not want to be blindsided by something I didn't think of. Thanks again!

Oh, I guess that's what it means. Thank you. I guess the money that should be paid by the 16th will come out of the sale instead.

Hi, just thought I'd send an update.

I'm going in to my lawyer's tonight to sign paperwork, that way I don't need to be there at closing on Friday. Closing is set for Friday, and I will not be there, so i don't have to see jerko.

He ended up paying for half of the dumpster, the other half is being paid by out realtor and lawyer out of their pockets (they just wanted the issue to go away and it's only $60 each). The lawyer convinced him to dismantle the aviary cage. I had someone set to go do it, but now they don't have to, which is nice.

I do still have an electric heater of his, but I'm not sure if he even wants it back. I'll just wait and if he asks for it I'll give it to him (through the lawyers of course).

The mail seems to have finally straightened out - i.e. it is going to the post office box like it's supposed to.

Jerko still needs to move out and get all his things out by Thursday for the final walk through. I keep telling the realtor and lawyer to not take it for granted, that he may not realize he needs to leave the house. They laugh but I am serious, he may not have plans to move out in the next two days.

IF we close on Friday like we're supposed to, it should all be over. We should both get the money that we agreed on before the house went on the market. I should never hear from him again and hopefully he'll move away to Florida and work for his brother. He did get a job (gasp and faint!) but hasn't been paid yet. I think he's had the job for about two and a half weeks now - a sales job.

SO, hopefully it's finally almost done! That would be nice. It may still fall through though - remember when I was closing on my new house and they kept changing the date of closing, pushing it back. But there's an update! Talk to you soon!

We'll know tomorrow sometime HomeGuru!! The suspense is killing me. Hopefully it's a done deal and we'll close tomorrow - I'm happy I won't have to be there.

Prompted by your message, I just called my realtor. LOL she said he's looking for a place to live NOW!!!!! He's had 2 months to find a place, closing is for tomorrow afternoon, and he's still in the house. LOLOLOL.

So, barring unforseen events it should end tomorrow. Thanks again!

Well HomeGuru, you'll be happy to know I'm finally out of your hair! It's all over- we closed and I should be picking up the check tonight. All was split the way it should be and the new homeowners seem happy. Closing went through without a hitch, suprisingly enough. I can't thank you enough for all of your help; when I first started this thread I thought it was hopeless and that I'd have to live with that jerk forever. You got me started on the way to get out and it worked. I talked to so many lawyers before coming here and they all told me I was completely out of luck, I'd lose my money, credit and pets. You gave me the idea for a partition action, and here I am with money, pets and credit! So thanks again and take care.
