All beneficiaries in agreement, will a letter to the bank suffice?

What is the name of your state? North Carolina

Here is the situation. An amended trust states that the principle of a trus is to remain unused untill the death of a benificiary (a death row inmate), then it will be give to the remaining beneficiaries (the grandchildren). The original trust stated the grandchildren would receive the principle once the youngest reached 25 years of age. If all the beneficiaries are in agreement and sign a letter to the bank, would the bank turn the principle over to the grandchildren avoiding a civil suit.
