I lived in a major metro area, I know it was AMZL because I'd see the guy in his personal car delivering. I have just the opposite experience. More often than not the AMZL drivers deliver faster than if it were to go by one of the big common carriers (UPS/FEDEX). What I've noted is that often the PRIME shipments don't LEAVE the fulfillment center on time. As pointed out, Amazon is quite gracious when they screw this up. I've had a few items they just outright refunded because they were coming late (but they couldn't turn them around so they told me I could do what they want with them when they arrive).

Don't sit around getting mad and working up the idea you are going to sue. Just call customer service and complain. I bet if you're really fed up, they'll refund your prime membership.

I have it very often that Amazon is offering free one day delivery on prime products (on the article page itself) and when I put it into the shopping cart on checkouts offers me only free 2 days delivery and charges me for one day.

My zip code is qualified for one day.

"Great news! Prime FREE Same-Day and One-Day options are available for residential addresses in xxxxx."

Customer service does not understand why I am complaining.

Here's a thought.

If you don't like Amazon Prime, don't use it.
I no longer subscribe to Prime.

Without being able to get two day shipping on eligible items, Prime has no value to me.

Although I pre-paid for a years worth of Prime last year, I did not get a year's worth of free two day shipping. I had a year with a mixture of between 2-7 days shipping.

It was an easy decision not to renew.

I have no plans to sue. I have very little to gain from doing so.

I am disappointed. I have been a very happy and loyal Prime customer for 12 years. I have been an Amazon customer since the late 90s.

If they get this AMZL thing working consistently in all regions, I would become a member again.

Maybe a class action suit is something that might help motivate them.

Losing more valuable customers like myself would probably be an even better motivation.

I did complain several times. The last time was after I inadvertently let my membership automatically renew recently.

The agent was very understanding and professional. He assured me that these delivery problems would not happen any more. (Not the first time I was told this. There was still problems.)

I told him that unless he tells me AMZL will no longer be the carrier on my orders, the problems would continue. He said was unable to do that.

It is against policy to refund a Prime membership once it has been used. But he made an exception in my case.

1. Offer a $99 membership to get two day shipping.

2. Accept $99 from customers who want two day shipping.

3. Consistently fail to execute on the two day shipping.

They are taking money for a service, then not performing the service.

If you bothered to read your contract with Amazon, you'd find it was sufficiently weasel-worded that they do not guarantee 2 day delivery.
While the terms say you can't get a refund if you've used it, as stated Amazon is willing to adjust things for the good will.

You got your money back. Read the terms more carefully next time you sign up for such a program.

THere's no basis for a class action here or even a single party action.

What legal action are you looking for? If you are terming your membership, what is it you are looking for Amazon to do?

Give you a refund?

Change their advertising?

Change their advertising to not include two day shipping.

However, advertising

probably wouldn't have the same appeal.

Again, you are not a customer and you aren't out any money at this point. Furthermore, when Amazon isn't able to make the 2-day delivery window for some reason, they make good on it with refunded shipping or an extension for Prime membership. Lastly, they disclaimer the heck out of their Prime membership. In other words, if one would take a moment to actually read the disclaimers, one might have a better idea of what Prime actually guarantees.

There's the opening for a class action. Those who haven't demanded and got a refund could be eligible up to $99 each in the suit.

There are sufficient people just in this thread to show that your experience is not universal. That being the case, a lawsuit to force them to change their advertising (and there is no other way to force them to change their advertising) is by no means guaranteed to be successful.
