Apartment Fire - Insurance Issue

The adjuster that my GF is dealing with told her that the apartment complexes insurance contacted them and they will pay my gf's half but they were going to come after me for the other half.
Does your GF have an agent? I would have her see if her agent can do anything for her. Otherwise, I think I'd ask for a supervisor and see why they think you need to be liable when the policy is covering the dwelling(for her negligence/liability) and her personal stuff.

Definitely do a consult with an attorney. Many will do a free consult. At least in my state.

I realize you "pay for" the policy but as far as the insurance company is concerned, it's HER policy so SHE pays for it. It's the same for me, technically, my DH pays MY bills but my CC company sees it that I pay it because it's only my name on the account.

Your use of pronouns is making this a little difficult: if "they" told "them" that "they" would only pay half and "they" would come after you for the other half. I think I get it, though.

This is two insurance companies in a fight over payment. Your girlfriend can thwart her insurance carrier's plan to accept liability for only half of the damage by telling the truth to each carrier.

She should call the adjuster for the apartment complex's carrier and give them a recorded statement saying that it was her desk, her lamp, her mistake, and her fault that the fire started. She should tell them that you had nothing to do with it, because even though you live there, the negligence was hers. And that even the personal property that was damaged was hers alone.

Then she should call the adjuster for her own insurance carrier and tll him or her the same thing, and advise that she has told the other insurance company so.

No insurance carrier wants to sue you when there is a deep pocket who insured the liability risk sitting right there. This is your girlfriend's insurance company being petty and cheap.

I assume that she has property damage coverage as well as liability? Is her insurance carrier refusing to pay for her property damage under her personal property coverage? Or are they only going to pay for half of that damage?

Sorry for all the pronouns las! The policy has Personal Liability to $100,000 if that is what you mean. Her insurance company isn't refusing to pay they are just going to pay half, from the way they make it sound thats all the apartment complexes insurance is asking for and that they'd get the rest from me. Like you said perhaps they don't have all the information and her insurance is holding out on it so they don't have to pick up the whole tab.

Thanks for the advice! I will inform my gf of this and see what they say if we call them. If you have any other advice it would be appreciated!
