Case dismissed!!!!!!!!!!!!!!

Heres the e mail i recieved from my attorney today. An it only cost me 400 dollars in attorneys fees...but it was better than $8000.00




The defendant has agreed to dismiss its case with prejudice. I will furnish you with a copy of the Order once it has been signed by the judge and entered into the court record.

I TOLD you if you fight ASSet they will back down and dismiss !! The fact that you had a lawyer on your side just made it easier for you, they do NOT want to FIGHT !!!

Ya know Lady the more I think about, we ought to bookmark this thread and the one from TToby in late 03 as perfect examples of how to fight these lawsuits from junk debt buyers. Both of them made the collection agency go the hard way!
I'll guarantee they'd both clear up a bunch of questions from newcomers.

I think the key to defending SOL lawsuits is to never admit the debt is yours. Use discovery to demand a copy of the contract and an accounting,etc. Then, raise the SOL.
Here's a post from creditboards where a defendant did just that and the judge never even got around to making a call on the SOL. He just satisfied himself that AA could not even prove the debt was legimate.

The object of the execrise is to win. Did Mark win because AA agreed the SOL had run or, because they had nothing to tie him to the account?
We'll never know but it doesn't really matter.

I don't know what browser you use, but with Mozilla and Firefox you can simply email yourself the particular thread you want to retain. Then, store it in a Free Advice folder on your email client.
