Quincy: Thank you, while the road maintenance association is not included in the CC&Rs, it makes sense that they are breaching their fiduciary duty over their failure to enforce the Bylaws.

PayrollHRGuy: I am aware of the fact that this would be a civil - not a criminal action.

You have failed to take into account future invoices from the association for "maintenance activities" without the benefit of seeing bids, materials lists, invoices, etc. It's not paying the money per se, it's all about accountability.

Volunteer for the board in the future.

You could gather together other concerned members and approach the Board as a group.

Personally, I would not want to pay $500 unless I knew how they arrived at that figure.

People who live in an HOA may not have that option. Or, at least, not have the ability or the finances to enforce such an option.
Enforcement could be the bigger issue, especially since the records should be made available for review.

I think the next time I receive a request for $ from them, I'll ask to see their books and records again. If they deny that request, I won't pay. If they take me to court for non-payment, I'll counter sue for breach of fiduciary duty, over their failure to enforce the by-laws.
