Bank of America lied to me

I went a few dollars below my balance on my checking account, which I admit was my fault. I bought three things with my debit card and I got overcharge fees of $19 for each item I purchased for a total of $57 in overcharge fees.

So I called my bank asking if I could have the overcharge fees removed and the associate said that you have a 24-hour grace period to balance your account and the fees will be removed. But the fees remained.

So I called two days later and spoke to a supervisor who said there is no such 24-hour policy and the fees would remain. I asked to have my account closed with BoA and they refused because I was below balance. Well, I'm below balance because of the overcharges they said would be removed! I also asked for the name of the associate I spoke to two nights earlier and they said they knew who it was but refused for security reasons.

I'm thinking of taking them to small claims court on the grounds that I was lied to and their refusal to close my account. It's not about the money so much its the principal. Do I have any chance of winning?

And the judge will tell you, "Small claims is for money damages. If you are interested in principal, go to Federal court!"

Because the person I spoke to on the phone told me they would be removed within 24 hours and he represents the company. I was lied to.
and of course you don't know this person's name, their right to represent the company on a legal matter or anything else. You owe the money. Either pay it or be sued.

and after you dont pay they will close your account and report you to chex systems where you will not be able to open an account anywhere

It just happened to me.. :) There was a phone outage at my home and the bank 26 miles away. I had a bunch of stuff set to go with autopay. My direct deposit didn't get into the bank because of the phone outage. And I couldn't disable the auto bill pay because I had no way to log into it. I have $66.00 in overdraft charges. Yes, I can argue with the bank because of the situation with the lines down. Bottom line, I should have gave myself an extra day or two so I can make sure the money is in my account before the autopays get sent. Or I shouldn't use autopay in the firstplace..

Best is to eat up the charges and move on... ING Direct is going to roll out a kick butt checking account in February anyway. 3% interest with no minimum balance. $1000 in overdraft protection with no credit check and no reporting to the credit agencies. Free ATM's at 30,000 locations. Free Billpay.. I am probably going with them once its available.
