Hi GAGirl: According to No Lo Wanna Go, you are responsible for your cat even if it is in her garage . . . I don't believe that you should be - . . .

It is my understanding & experience in sm claims, (I could be wrong!) that the issue on hand (why she is suing you ) is your cats did damage to her vehicles. If she gives a perfectly good description of your cat, then I would think the judge would believe her. (Even if she is a nutcase.) You could be in trouble if she has any pictures of your cat. And - if your cat was in her garage, she may have taken some . . . Then it would then be up to you to prove they didn't. For your sake, I HOPE I'm wrong.

I do hope you are filing a counter claim of some sort . . .

Okay, we went to court on Monday and things turned out great.(For me, of course!)
The judge awarded her $100 because I admitted that my cats had been out before. Keep in mind, she was asking for $5,000!!! The video she provided was just horrible and I told the judge I could not say the cats did or did not belong to me. I could only see shadows of cats...no color, no markings. I was told by an attorney that the judge awarded her the $100 in order to "close her case." He basically said he thought the judge did it to keep her from dragging it through the courts again because she now had a "settlement." Regardless, I couldn't be happier!
Thank you all so much for your advice. You guys really helped me out. Happy Holidays to you all.
