What did he merge into? You were the one merging into traffic, not him! He was going STRAIGHT. You were going into traffic.

You must not be getting the point. 5 people have told you that you were in the wrong. Not one has agreed with you. Not one. Unless, of course, you look in the mirror.

Well, I am sorry, but I just don't think it is fair that I have to pay $485 for a bike that probably wasn't worth that when it was new (20 years ago). This does not seem like justice to me.

I agree, the biker is only entitled to being put back in the same position he was in prior to the accident. If you totaled his bike then you pay him what his bike was worth. He isn't allowed to be in a better postion.

Tell him he'lll have to sue and let the judge decide what his piece of crap bike was worth.

We didn't know that this was the thing you were mostly concerned about. All we kept seeing from you was an excuse for not being responsible for the accident (period).

I want to justify not paying the biker for something I do not believe I am responsible for. Whether that means I was not at fault or that maybe he should have come up with a reasonable amount for his damages.

Also, I almost went to law school last year (right out of college) but I decided to wait a couple of years (to become more mature/responsible). After speaking with all of you smug, know-it-all attorneys/ law-enthusiasts, I don't think that I will ever want to associate myself with your circle of people. All I want is justice in this case, my country and throughtout the world. You people cannot get past your egos to really understand someone else's perspective and situation. I am poor -- therefore $485.00 is a LOT OF MONEY to me!!! More than I ever have in my checking account!!!!!!

I have read a number of threads on this forum in which the person giving advice is down-right degrading to the other person. Just becuase some of us do not have our J.D., this does not mean that we know nothing about the law. GET OFF YOUR HIGH HORSES AND REALIZE THAT YOU ARE ALSO HUMAN!!

Just for the record, not everyone who replies at this site is a lawyer. In fact, you only had one that replied that was an attorney, and that was LAWYER-003 ( IAAL).

Of course, if you are able to settle this out of court that would be ideal. The biker probably won't agree with settling for the fair value of the bike, that is why it will probably go to court, but that is all he is entitled to.

Something similar happened to me last night. I was driving westbound (motorscooter) and another driver in a car darted past a Stop Sign going northbound. That's a very dangerous road & many accidents have happened nearby. The driver was cited for failing to yield and thankfully had full coverage insurance. I wonder who's going to pay to have my vehicle repaired? I was not carrying insurance for bodily injury/PIP/vehicle damage.

petodoane should consider becoming a social worker IMHO. Law is not always a "pretty" thing that can be easily separated into right vs. wrong, good vs. bad. Just my .02
