Michigan Detroit.
Filed for GC with US wife / RFE for the Birth certificate, we send all school certificate as well as an affidavit from mother.
GC Interview: Officer said we need the birth certificate. I was born in India. Immigrated to Canada 7 years ago.
Indian consulate refuses to make birth certificate / Canada Cannot.
Is there any way around.

You know, I would not expect a US consulate to provide me with a birth certificate. I would expect to get one from the municipality where it is recorded, and would go to the website for that municipality to find out the information.

Do you know where you were born? Look to see where the birth was registered to find the directions on how to obtain a copy.

If your birth was never registered, then you'll have to use alternative measures.

I was born in India. But the Indian embassy cannot help since I am not an Indian Citizen.
I am Canadian for the past 8 years. I have no one in India so I don't want to go to India and may not re enter US.
Can the USCIS overlook birth certificate

Almost definitely not. Have you taken any steps to research the method of obtaining your birth certificate from India?

Again, even if you were an Indian Citizen, the embassy is not the place to go to get a birth certificate. India is a huge country. Find where your birth was registered.

What state in India is this?

P.S. And no, if there is a birth certificate, they want it. There are alternatives for certain situations, but being born in India is not one of them.

State is Delhi.
Its just that I have now no one living there. It can be a major expense. Second I am on an EAD . They may not let me in>.

Do you have a Canadian passport? How did you get an EAD with no birth certificate?

That's odd. When I became a US citizen I had to show my British birth certificate.
I just checked, and Canada has the same requirement. To apply for either a permanent resident card or Canadian citizenship, you must show your birth certificate.
What is your immigration status in Canada?

I have a Canadian Passport
And the only way to get a Canadian passport is by being a Canadian citizen and the only way to become a Canadian citizen is by getting a Citizenship certificate and the only way to get one of those is by showing them your birth certificate.
This is now going in circles.
