A puppy I had sold last year was given away without my written permission as stated in the contract but, nor was I notified there was a problem in the household he was to also. I have sent the old owners a letter stating they were in breach of contract that they would have to give me all the new owners information so I may contact them and if the dog was being well taken care of a new contract would be drawn up in their name and they would resume their life, I also stated if this information was not supplied to me the dog was to be returned to my care in five days from the date on the letter(I sent it certified return reciept and kept a copy of the letter) The new owners contacted me stating they did not feel "comfortable" having me goto their house I, stated they could come to mine with the dog his paperwork showing he is up to date with vaccinations and heartworm testing etc... and the dog so I could see for myself that he was doing ok and they refused that also. I have sent out a letter as requested by the old owners that if the new owners showed proof that the dog was being taken care of and I saw the dog I would not take him from them I agreed and that letter will be sent out this morning but the new owners are saying they are not willing to comply. I want to know what legal avenues can I proceed with to have the dog returned to me if the new owners do not wish to comply with the written contract I know the old owners are ultimately responsible because it's their signature on the contract I, would just like to know what to do next.

No court would uphold this contract.

Once that animal is gone, you have no control over it.

Yes, I have bought and sold animals and yes, I have been the judge in cases such as this.

I would like to state to the person who is money hungry hung up. I have contacted the person whom I had sold the dog to that my concern is for the dog's well being. If I spoke to the new owner and stated to them it was not my intention to take the dog away but to make sure that he was in good condition and up to date on his vaccinations and heartworm testing and medication. In reference to your comment about my pot to piss in, I will do what ever it takes to make sure the dog is okay, you idiot and would never sell you dog as much as look at you and if you commenting on my house. Are you stalking me over a question? I believe you need to check your mental stability on this one. The dog has legally regarding paperwork, has been returned back into my name. I have also located where the new owners live. There's your pot next I will goto the District Attorneys office, because if the new owners refuse to show me the dog is in good health, what are they trying to cover up. I keep in touch with all of my dog owners! FOREVER! If this is too much for you handle that a breeder cares about the dogs that is your problem and you need to get off your high horse and take a good look at yourself for what you have written! Are you insane? I have tried everything possible to resolve this without going to court but, if I have to take the dog back I will! I never forget these puppies or dogs. I don't just sell them and throw them out the door and say that's it. No! I am friends with each and every one of them and there isn't anyone of them that can not come to me at ANYTIME and ask me for advice, or help with any situation. That is what I am here for. You can goto those backyard Breeders who don't give a damn about their dogs but, don't attempt to come to me!

Thank you. I love my dogs, plain and simple and I have rescued others also. The one male who became a search and rescue dog, was beaten with a pan and poisoned. I spent hundreds of dollars making him well. He bleed every time he would have to goto the bathroom (globs of blood) for three weeks until we got it under control not, to mention he went to five homes before he turned 1. The other male, was 54 pounds when I got him and 77 when he left both dogs did not know how to sit, lie down, stay or even to not knock you down when they saw you. He was starved almost to death and no vaccinations and consumed with worms. The female, I took her in after her mother came down with cancer and I would have kept her if her and my female would have gotten along. I am a certified Chef top of my class. Unfortunately due to an injury I can not return to my profession. I believe I will return to vet tech school. All of my animals have the best care, and are in perfect health. I make sure I give them everything because, they give me everything and I want the same for not just the puppies but, any dog that comes into my care because I love those dogs too, even if I didn't raise them. The majority of the breeders out there are so un ethical it drives me nuts. A true boxer lover will try to improve the breed, that is why I have a dog coming to me from Germany. Anyone who wants to make ASSUMPTIONS about my life; go ahead it doesn't bother me. What bothers me is, if you told me you are checking me out or my house. I am going to have to assume the worst and wonder if you have some other intentions other than to answer my question. Let me inform you, I am always prepared! I thank everyone for their assistance in this matter that is so close to my heart I, can not sleep. I wish everyone well and my warmest regards. Antoinette

Let us know when the DA laughs you out of their office. What are you going to tell the DA that allows you to demand to see a dog that is owned by someone who never purchased it from you? You have NO connection to the new owner. Your only connection is to the former owner.

And because the former owner breached the initial contract, the dogs become the illegal property of the initial owners. They would be in possession of stolen goods. They then sold off these stolen goods to the "new owners". But they did little more than buy stolen goods. These "new owners" have stolen goods.

so show the DA the judgment you have that makes you the rightful owner of the dogs due to the breach of contract of the sellers. if you don't have such a document, the DA will kindly show you the door and ask you not to return.

I think you can safely assume that if you breach a contract that gives you ownership of the dog, you lose all rights to the dog since you broke the very thing that is keeping the dog under your ownership.
