Breaking a stipulated court order ???

My ex has broken a court order ...Neither party shall remove the minor child from the state of California without prior written consent of the other party or prior Order of the Court first having been obtained... He took her to Las Vegas .

The issue is he broke this order and I feel that he need's to understand that what he did could have had grave consequences .

How do i go about putting him on notice to this fact and have it very clear that if he ever attempts it again I will have him back in court and I will not be kind ?

Has he already returned with the child? Do you have proof that he removed her from the state?

First you need to be certain that this includes vacations. Generally, that kind of clause is intended to prevent relocations, not vacations.

The child is home and the proof is my child told me and she stayed at the Bellagio.
Also when I asked my ex about it he claims he tried to call me ...sorry a written note saying it is allowed is what is required. (I'm sorry if I come across snippy...but he pulls this kind of thing often and the time has come to keep him in check . )

Well, unfortunately just a child telling you where she stayed is not going to be proof enough..Children have been known to say things all the time!! If it states that even for vacations, and not just moves he has to have written notification then you could file for contempt..However, can't really see their being any "grave consequences"! More than likely, judge would just tell him to make sure to get it in writing next time. Your better route to save time and money might just be sending dad a letter CRC stating that in the future you request he follow the guidlines of the court agreement and sent his request in writing.

I don't think you are snippy at all, I think you are over reacting, controlling and being a total biatch! Really, what grave consequences, and what are you going to do in a court room that would be "unkind"? You might want to remember that there will be a judge in that courtroom that might have a little something to say as well. Really, he takes his child to the Bellagio often??? lucky kid.:cool:

He broke the court order and will do it again if he can get away with it...I don't think you're snippy. If he isn't going to follow the court order what's the point of having it??

Because he may be interpreting the court order to mean something different, and he may be right!!! Alot of court orders that stipulate written consent to remove child means moving, not necessarilly just for vacations.

Because my crystal ball is in the shop, i do not know what he thinks....only what she has written.

If you do not know what he intrepreted it as, or what the actual exact wording of the court order is then how can you advise the poster he broke the court order?

She said he did and IF he did in fact break it...she isn't overreacting...that's all.....

"She said" is not necessarily a valid truth. Of course "she says" he broke the CO. It's HER story, looking for the answer SHE wants. Still doesn't make it true. ;)
