Buyer wants money for shed

:( :confused: What is the name of your state?I live in California, Buyer did his own home inspection and said home need 14,000 in repairs but would take 5,000. cash instead of repairs. I call and his repairs re -checked none where as he stated only need glass replacement. Now Shed that was built by my father with out a permit has termites and must be removed. Buyer had never been in shed due to no keys. Shed was not listed with home description, home is 50 years old and listed as a fixer upper and is price that way! 30,000 less than same house which just sold accross the street with no shed.He wants cash back since shed must go not worth fixing. Help and to give him already 1,000. credit. Where do I stand?? :confused:

A: Give him his money back and find another buyer. I am assuming you have no contract and are still negotiating.

:confused: Thank you for the quick reply, I am in escrow termites were found on Final inspection. Buyer had nerver been in shed nor was it in selling description of property. The shed would have had to go even with out termites due tonot built to code and no permit. :eek:

A: Explain again exactly what he wants and why he wants it. I'm missing something.

Now that we are in escrow buyer needed to sign off on shed during his inspection he had not been in shed. Final termite inspection found shed need to be removed. The shed was built with out permit not to city codes. Had to come down any way. Now since the buyer won't have the shed he wants 2,000. for a new shed. :confused:

Was the shed included in the sales contract as going with the land?

No, buyer had seen it when they were checking out the property. But because they never went in it or was it list on description of property for sell, put it wasz added as a condition to see inside before signing it off after home inspection.

Then tell him he's not getting his $2000 or a new shed either one.

If he objects, ask him to show you in writing where he is supposed to get a shed or $2000.

Was it on your disclosure? What did your RE agent say?
If you failed to disclose you would be required to compensate the buyer appropriately unless you have removed the shed prior to listing and sale since it was not disclosed. A $2000 credit is less than the cost of demo/permits and rebuilding.

The shed was not on the contract or any disclosure. Due when they did the home inspection it was locked and they could not go in side they put it as a condition that they neeeded to sign off after they went inside and inspected it. But we had the termite inspection and found out it was not to code --built with out permit and had termites and had to be taken down. When I disclosed this to them that is when the demanded 2,000. :confused:

Let me guess, you are selling the property yourself to save money and you have no idea what to do and now that is costing you big time. My previous answer stands.

My agent is with Realty Executives, I am not selling the house by myself that would be as stupid. Shed was not place as part of the property for sale and not placed in the disclosure untill it was inspected, that is how we found out it was not built to code and had termites.

If the shed was NOT included in the contract, then WHY does the guy think it is?

What does your RE agent say?
 
I am not a realtor or lawyer, but based on my experience buying and selling houses it seems like you have some choices:

1 Give the guy $2,000 and sell your house to him.

2 Say no. Then the sale may or may not fall through. He may well be able to get out of the contract or he may just buy the house anyway, this could be a bluff.

3 Negotiate something inbetween.

This is all subject to what the contingencies read like in your contract of course, talk to your realtor or a lawyer about that.
