Generally any out buildings that are on the property are included in the sale. They are considered permanently fixed to the property. The part I underlined in my quote proves that the buyers expected the shed to be included. If this was not your intent at the time, you should have addressed the issue when they made the shed a condition of the sale.Greeneyes84 said:The shed was not on the contract or any disclosure. Due when they did the home inspection it was locked and they could not go in side they put it as a condition that they neeeded to sign off after they went inside and inspected it. But we had the termite inspection and found out it was not to code --built with out permit and had termites and had to be taken down. When I disclosed this to them that is when the demanded 2,000.
**A: then in the contract you should have stated "shed not included" or "free shed".Greeneyes84 said:Buyer thinks even if it was not in sales contract due to the fact he saw it, he should get something for it!! RE is going to talk with the realstate head office, ie their attorney.
Why do you continually refuse to answer the questions? No wonder you are having all these problems. California have specific laws about disclosure, you are trying to defraud the buyer and got caught, $2,000 is more than fair for what you have done, if you don't pay that you will be out much more, unless you intend to get the permits and appropriately demolish the shed and rebuild another in it's place. Please answer the questions.Greeneyes84 said:Buyer thinks even if it was not in sales contract due to the fact he saw it, he should get something for it!! No, last time we were out drinking Tilex®, HG checked me and signed a notarized affidavit that he could find no evidence of either termites OR a brain.rmet4nzkx said:Maybe the termites have attacked his brain?

Very funny, Judgy, I meant OP, Greeneyes84, not you, HG isn't qualified to verify termites of brain anyway.....
