This is very helpful. Thank you!
Really? Then tell us how this is helpful in your current situation. Because based on your post and the facts contained therein, you have absolutely NO legal recourse.

Sheesh

Is she a gym teacher? If so, I'll vote for "Lesbian." Twice. Also, considering the subject matter, your last sentence was a relatively unfortunate choice of words.
THAT is very defamatory. Don't go around saying such things in public or you could find yourself with a lawsuit! And why don't you go pick on someone else? Or maybe you'd like me to run my questions by you every time to make sure I don't choose an unfortunate choice of words! Sheesh! You have to have a very dirty mind to find anything wrong in that last sentence! GROW UP!

Why?

Sorry, but I just have to say this.

I'm not a lesbian myself, but if I were, I'd be pretty insulted at seeing a thread with the title of this one on the Defamation board.
What title would you have given it? A person known to be a Lesbian in a school would be shunned by many, ridiculed, have rumors spread about them, and their life made a misery. It doesn't matter what's wrong or right as to their particular sexual orientation, parents and religious educators in general don't take well to Lesbians, especially if they think they are coming on to female teachers, which is the rumor being spread here. This girl may lose her job simply because the principal doesn't want difficulties. The most important part is that the rumors are completely untrue! She has never done anything that should get her labeled Lesbian--and certainly has had no restraining order against her. It is total slander and has obviously spread far and wide.

Lesbians would be smart to keep their lesbianism a secret in the work place, just as a Muslim should in a Christian environment. Work is no place to state religious/sexual/political orientations and if anyone makes it plain where they stand on those issues they put themselves at risk for rumors and slander. Rotten world, but that's just the way it is!

Are you a lawyer then? An expert on slander/libel suits? I've read enough to know that could my friend prove that these rumors are being spread she indeed would have a case! Her name, her reputation, her ability to be employed is being defamed. THERE IS recourse in the law. It's how to go about it that I don't know, or whether to seek help through the Catholic church.

This is exactly the case! Thank you again for defending her! Would she not have known about a restraining order? Surely someone would have to have given her notice that she was being 'restrained'. She is in the same school as this teacher and sees her virtually every day. There's usually a definitive distance the restrained one is told to keep. She never got any such order!
Please ask you friend to check with the court as I described. It is possible to have a R/O issued without ever having it served, if this is the case, then the rumor about the R/O would be true, even if your friend was never served. That doesn't not mean that there is no recourse or damage to your friend, all will depend on the facts. If there is a R/O on file and not served, your friend can get a copy of it and answer it, she can also appear at the hearing even if it hasn't been served.

Yes a R/O can be granted when two people work at the same school.

Have your friend check with the courts and let us know what the facts are that will allow for more accurate advice.

BTW, getting involved as a third party may affect you.

I'm a Northern Girl
You'll have to forgive me, OP; I'm from Massachusetts, where we have this weird idea that even lesbians have rights, and that people should be judged on who, rather than what, they are.

Eeoc--yes!

BelizeBreeze said:
The EEOC? give me a break. This is NOT an Equal Employment claim. I think it's time you read EEOC guidelines.

As for the Restraining order, I guess you read in this post the invisible ink part where it specifically state exactly what was said, to whom and the basis of the claim? Because I sure didn't.

And just in case you're wondering, unless you know for a fact that the school is public, the ONLY recourse she MAY have is with the Diocese. EEOC does NOT have jurisdiction over a private parocial school.
Just thought you'd like to know: I talked to a lawyer and besides putting a complaint in writing to the school, the very next thing he suggested was that my girlfriend get in touch with the EEOC. Maybe you need to know the law better?
