What is the name of your state? VT. My ex lost his job 2 days ago. He was let go due to someone complaining about sexual harassment. I don't know the whole story and told my kids I didn't want to hear it. Anyways, he just took me to court for contempt for getting behind on CS. I was not found in contempt due to my illness during the time out of work. He now is wanting more money for CS since he has to pay on his new 400,000 home mortgage, and I am only living in an apt, he feels I should give him more money until he finds a job. This just doesn't seem right. He gets almost half my paycheck now. The kids are with me 12 days each month. He says he can get more money since he was fired. He cannot collect unemployment due to what happened at work. Should I just send him what I can, even if only an extra 10.00 a week?? Faith

No you should not send him what you can. I don't think he can get more CS because he lost his job, but if he thinks he can make him go through the courts to get it ordered. thats just my opinion and may not be legally accurate, so wait for some more responses.

The ATTORNEY GENERAL in TEXAS only considers the NCPs income.

No, I'm not confused. VT is a shared income state. Which means that BOTH incomes are taken into account.

Jaxpink, you are confused and need not answer questions on this site until you have a law degree. Vermont bases child support on the income shares model. Except in situations where there is shared or split physical custody, the total child support obligation shall be divided between the parents in proportion to their respective available incomes and the non-custodial parent shall be ordered to pay, in money, his or her share of the total support obligation to the custodial parent.

OK, here's what we need you to do. If you know a lot about Texas child support, answer those questions... however, not every state operates like Texas. So, put your tail between your legs, apologize for giving the wrong information and just sit back for a while. This isn't the first time I've seen (today) that you've given some advice left of center.

It's ok not to have an answer to everything. Like you've been told.. VT uses the income shares model (which Texas does not). Calculates differently. In other words.. whole horse of a different color.

Because this man enjoys stalking me using the courts. I would rather give extra money than to have to go through the hearings he sets up. The last hearing he got copies of all my medical information by the judge, and was told only he was to see it and no one else. Yea, right. I was shocked the judge did that..but..it proved to my ex I was ill and not lying. Plus I have 3 children with him, and they are important to me, I don't want them suffering due to his issues.
