he wouldnt work and im trying to go to school and i have a job and any money i make he spends and he wouldnt watch the kids even though he was sitting at home. weve been staying at my dads house since last year.

So? You legally COULD NOT KICK HIM OUT OF THE MARITAL RESIDENCE. A court order is necessary for that. Plain and simple. You need to file for divorce and hope dad doesn't try to return to HIS home. Oh and get yourself checked for STDs.
