Can I Get Terminated For This?

A friend co-worker of mine were chatting online and it turned out that we ended up discussing sexual stuff almost to the point that we were having cyber sex.

We both were at home so away from the work premisis.

There was no harassment.


Could I get fired for this even if she saved the chat script and forwarded to management?
I am guessing since we were both outside of work premises so they can't terminate any of us.

in Texas they can let you go for anything without a cause.

So any topic posted similar to this would be YES they CAN terminate you.

I spoke to her today and she said 'why would i do that'..'i have a crush on you.'


she also just got promoted and moved so she can be closer to work.

Exactly. And since none of us are psychic, we have no idea what your employer would do if your coworker complained about this. Conduct outside of work CAN still be considered sexual harassment in some cases. Of course if the chat transcript shows her as a willing participant in the conversation, that could hurt her case. But it's always safest to avoid hitting on your coworkers, in or out of work, unless you are SURE they are interested (and even then, it's risky).

Based on this and your previous question in which you posted a transcript of an IM conversation you have with someone and then asked if it could be considered sexual harassment, I think you should step away from IM'ing, online chatting, etc., until you can have a conversation that doesn't involve sex.

I stated earlier that there was no sexual harassment.
She has a crush on me. She checks me out at work and touches me sometime, i don't do anything.

But this was OUTSIDE of work premisis.

she has a crush on me though. she checks me out at work and touches me..but i dont do anything that is sexual. she seems to enjoy it..its like a mutual agreement outside of work.

First of all, yes, you can be fired for this. So can she.

Second, it is possible to harass someone without being aware that you are doing so.

Third, if the employer has a problem with the two of you having a semi-sexual relationship (touching, e-mails, phone sex) either or both of you can be fired whether either of you complains or not.

But we were at HOME.
There was no harassing.

And quite frankly, even if she never does anything of the kind, you don't seem to be catching onto the fact that is does not matter a damn if there was any harassing or not. If your employer finds your relationship to be inappropriate or interferring with work, then he can fire you out of hand, regardless of whether there was any harassment or not.

You asked a question. You got your answer. I don't care how much you want someone to tell you that no, you cannot be fired for this, that is not the correct answer. You CAN be fired for this and that is the answer, period.

No one here is a mindreader. No one here has a crystal ball. No one can tell you if you WILL be fired or even what your chances are of being fired. But you CAN be fired and no matter how many times you whine that you were at home or that there was no harassing, that answer IS NOT GOING TO CHANGE. What part of that do you not understand?

Mad at me for what? How would this effect our work though? There is a professional relationship at work though.
