Can I sue walmart for not giving me my refund.

That's the whole thing about it is that Walmart refuses to give me back my refund after I physically went into Walmart and show them my bank statements that they did not give me my refund. And that Walmart is telling me that they're not going to give me my refund

You said in your OP, that you used your bank card? did you not?

call the number on the back, tell the person who answers that you would like to dispute a charge

give them the date and time you returned them, they will then ask you for some information and you can send them the receipt that Wal Mart gave you. It is not that hard, they will issue you a temporary refund until they clear the investigation with the merchant.

Unless there is more to this than you are stating in this thread? Are you wanting cash back which on an ATM/ Debit card with pin is a possibility.

WUT? so you have been waiting on a refund from them for 3 plus months? You can still dispute the charge if you ACTUALLY returned them.
I am confused as what it is you want to accomplish.

Read the terms relating to your "bank card" (whether that's a debit card or credit card or whatever). My guess is that you're now beyond the time to submit a dispute, so you likely have no recourse with your bank.

As far as the merchant goes, sure, of course you can sue over $60. If you think that's a valuable use of your time, then go for it. However, you noted that this wasn't the first time something like this has happened, so I'd suggest taking your business elsewhere.

Because the issue is YOU RETURNED THE ITEM, AND THEREFORE SHOULD NOT BE CHARGED FOR IT.

There are 2 ways to deal with the problem, and you've only addressed the first half: you returned the item, and allegedly were told they'd issue a credit on your card. The credit has not appeared. The local yokals at your local Walmart aren't being helpful. So: CALL THE NUMBER ON THE BACK OF YOUR CARD and contest the charge, as it should have been refunded by now.

There's more than one way to skin a cat. But you only try more than one way, after the first way doesn't work.

Yes. You can sue. The cost of filing is between $35-$90. It would be free to call and dispute the charge. Your bank will credit the 58.00 (to you) and deal with WalMart. Make sure you keep your slip from when you returned the pants as proof of the return of goods.

Yes I still have my slip for my return

You can sue.

You can ALWAYS sue.

The better question is: 1) can you win, and, 2) can you win enough to make it worth the effort.

1) In order to have a strong case, you have to show that you tried to resolve this. One of those steps is by DISPUTING THE CHARGE. Judges don't like people wasting their time with issues that should be easily handled outside of court.

2) How much $ and time do you want to spend on this?
