Lawyers turn down cases all the time for a whole host of reasons that can have nothing at all to do with the merits of a case.And unfortunately, what happens during surgery is the most important part.
I am not seeing the delay as critical; since Allan ignored his problem, it might reasonably be seen as not too urgent to others.
It's certainly not unethical for a lawyer to refuse to take a case.
AnotherAlan should not be too discouraged by the refusal of a handful of attorneys showing no interest in taking him on as a client. If NO attorney finds the facts of his case compelling, however, it could be a good indication that he has no legal action to pursue or worth pursuing.
It is interesting to me that Alan waited over a year (1/2018 to now) to consider a malpractice suit.
